Calunsag City Councilor (SK Federation President) (OL) WHEREAS, Republic Act No. 9640, amends Section 140 (A) of Republic Act No. 7160, or the Local Government Code of 1991, as follows: cTACIa "Sec. 140. Amusement Tax . (a) The province may levy an amusement tax to be collected from the proprietors, lessees, or operators of theaters, cinemas, concert halls, circuses, boxing stadia, and other places of amusement at a rate of not more than ten percent (10%) of the gross receipts from admission fees." WHEREAS, it is deemed proper and appropriate to further amend Ordinance No. 01, Series of 1996, otherwise known as the General Santos City Revenue Code of 1996 to conform with the provisions of Republic Act No. 9640; NOW, THEREFORE, on motion of City Councilor Eduardo D. Leyson IV, duly seconded by City Councilors Elizabeth B. Bagonoc, Margareth Rose N. Santos and Virginia T. Llido, be it RESOLVED, as it is hereby resolved, to enact the following Ordinance: GENERAL SANTOS CITY ORDINANCE NO. 007-10 AN ORDINANCE FURTHER AMENDING ORDINANCE NO. 01, SERIES OF 1996, OTHERWISE KNOWN AS THE GENERAL SANTOS CITY REVENUE CODE OF 1996, PARTICULARLY SECTION 16, ARTICLE E, CHAPTER II THEREOF TO CONFORM WITH THE PROVISIONS OF REPUBLIC ACT NO. 9640 OR AN ACT AMENDING SECTION 140 (A) OF REPUBLIC ACT NO. 7160, OTHERWISE KNOWN AS THE LOCAL GOVERNMENT CODE OF 1991 Hon. Eduardo D. Leyson IV Sponsor Hon. Remus P. De Claro Co-Sponsor Be it ordained by the Sangguniang Panlungsod, City of General Santos, that: SECTION 1. Paragraph 1, Section 16, Article E, Chapter II of Ordinance No. 01, Series of 1996, otherwise known as the General Santos City Revenue Code of 1996, is hereby amended to read as follows: "Section 16. Imposition of Tax. There is hereby levied amusement tax to be collected from the proprietors, lessees, or operators of theaters, cinemas, concert halls, circuses, boxing stadia, video products lessors/owners, resorts, and other places of amusement at the rate of ten percent (10%) of the gross receipts from admission fees or rental from video tape/cd/dvd: Provided that there shall be two (2) years moratorium for resorts accredited by the Department of Tourism." SECTION 2. Repealing Clause . Paragraph 1, Section 16, Article E, Chapter II of Ordinance No. 01, series of 1996, otherwise known as the General Santos City Revenue Code of 1996, all other ordinances, resolutions, orders and other issuances in so far as inconsistent with this Ordinance are hereby amended, repealed or modified accordingly. SECTION 3. Effectivity Clause . This Ordinance shall take effect after fifteen (15) days following the completion of its publication in any newspaper of general circulation within the City of General Santos.
