December 15, 2009 FIRB RESOLUTION NO. 024-09 SUBJECT MATTER : National Kidney and Transplant Institute (1) WHEREAS, the National Kidney and Transplant Institute (NKTI) provides specialized renal care services to a number of patients, with charity cases constituting a significant proportion thereof; WHEREAS, the operations of the NKTI require the replacement of outdated equipment and continuing provisions of supplies and materials, most of which are not locally available or are not available in the quantity and/or quality required, thus prompting the NKTI to import said items and in the process incur taxes and duty liabilities thereon; WHEREAS, there is also a need to ensure that all importations covered by this tax subsidy grant will be used exclusively by the NKTI in its operations and not for other purposes; WHEREAS, there is a need to adjust the amount of the tax subsidy to be granted from P19,100,000 to P12,600,000, net of the P6,500,000 allocated for the hospital beds which will be delivered in 2010; NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, to grant tax subsidy to the NKTI in the amount of TWELVE MILLION SIX HUNDRED THOUSAND PESOS (P12,600,000.00) only representing taxes and duties on its 2009 importations of various laboratory and surgical supplies and equipments: Provided, however, that: (a) the initial issuance of the Certificate of Entitlement to Subsidy (CES) shall be limited to P69,094.00 only representing taxes and duties due on importation [five (5) shipments] with billings from the Bureau of Customs (BOC); and (b) the subsequent CES shall be issued upon submission by the NKTI to the FIRB of the required Billings/Statements of Accounts and/or documents evidencing the importations: Provided, further, that all hospital supplies, materials and equipment for which tax subsidy is granted shall form part of the regular inventory of the NKTI as certified to by the resident Commission on Audit (COA) auditor of the NKTI: Provided, finally, that such availment shall be in accordance with the terms and conditions of Section 13 of the 2009 General Appropriations Act, subject to the availability of funds therefor, pursuant to the terms and conditions of the Rules and Regulations to implement the Subsidy Provision under Executive Order No. 93.
