December 15, 2009 FIRB RESOLUTION NO. 023-09 SUBJECT MATTER : Philippine Heart Center (2) WHEREAS, the Philippine Heart Center (PHC) was granted tax subsidy by the FIRB in the amount of P31,341,997.50 pursuant to FIRB Resolution No. 17-09 to cover the taxes and duties due on its importation of hospital equipment and supplies pursuant to an importation plan submitted by the PHC to the FIRB and provided that such items are certified to as not locally available in sufficient quantity, of comparable quality and at reasonable prices; WHEREAS, the PHC is requesting to amend the said importation plan to enable it to cope with the increase in the number of bed capacity and patients as a result of its two (2) new wards; WHEREAS, the requested change will not result in an increase in the amount of tax subsidy previously granted under FIRB Resolution No. 17-09 but in a decrease in said amount from P31,341,997.50 to P31,069,125.00; WHEREAS, the PHC's report of taxes and duties availment for the fourth quarter and which will cover PHC's importation until the end of December 2009 amounts to P1,120,527.00 only; WHEREAS, most of the items included in the amended importation plan and for which tax subsidy is hereby granted have been certified to by the Bureau of Health Devices and Technology (BHDT) of the Department of Health (DOH) as not manufactured locally in sufficient quantity, of comparable quality and at reasonable prices; aDECHI NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, to approve the request for the amendment of the importation plan of the PHC: Provided, however, that the tax subsidy covering the taxes and duties earlier granted to the PHC under FIRB Resolution No. 17-09 shall be in the amount of SIX MILLION THREE HUNDRED TWENTY SIX THOUSAND SIX HUNDRED SIXTY SEVEN (P6,326,667.00) only representing the taxes and duties on its 2009 importations of hospital supplies, materials and equipment: Provided, further, that: (a) the third Certificate of Entitlement to Subsidy (CES) shall be limited to P1,120,527.00 only , representing the taxes and duties due on its importations [six (6) shipments] with billings from the Bureau of Customs (BOC); and (b) certification that all hospital supplies, materials and equipment for which tax subsidy is granted shall form part of the regular inventory of the PHC as certified to by its resident Commission on Audit (COA) auditor: Provided, furthermore, that such availment shall be in accordance with the terms and conditions of Section 13 of the 2009 General Appropriations Act, subject to the availability of funds therefor, pursuant to the terms and conditions of the Rules and Regulations to Implement the Subsidy Provision under Executive Order No. 93.
