August 4, 2022 FIRB RESOLUTION NO. 021-22 WHEREAS , Republic Act No. 11534, otherwise known as the Corporate Recovery and Tax Incentives for Enterprise (CREATE) Act, aims to, among others, develop a more responsive and globally-competitive tax incentives regime that is performance-based, targeted, time-bound, and transparent; WHEREAS , Section 298 of the National Internal Revenue Code (NIRC) of 1997, as amended by the CREATE Act, provides that the Fiscal Incentives Review Board (FIRB) shall have a Technical Committee which shall serve as its main support unit and perform functions as may be assigned or delegated by the FIRB Board, and shall be composed of the following: Undersecretary of Finance as Chairperson; and (1) Undersecretary or Assistant Secretary of the Office of the Executive Secretary, (2) Undersecretary of Trade and Industry and Board of Investments (BOI) Managing Head or Assistant Secretary of Trade and Industry, (3) Undersecretary or Assistant Secretary of Budget and Management, (4) Deputy or Assistant Director General of the National Economic and Development Authority (NEDA), (5) Commissioner or Deputy Commissioner of Internal Revenue, (6) Commissioner or Deputy Commissioner of Customs, (7) Commissioner of the Philippine Competition Commission, and (8) Director General or Chairperson or Administrator of the Investment Promotion Agencies (IPAs) whose participation in the deliberation and decision-making process is limited to the matters concerning their IPA, all as members of the FIRB Technical Committee; WHEREAS , the Technical Committee to the FIRB Secretariat shall be composed of the following, viz. : Undersecretary of Finance Antonette C. Tionko as Chairperson; and Undersecretary of Trade and Industry Rafaelita M. Aldaba, Undersecretary of Budget and Management Joselito R. Basilio, OIC Undersecretary of NEDA Carlos Bernardo O. Abad Santos, Deputy Commissioner of Customs Vener S. Baquiran, Deputy Commissioner of Internal Revenue Marissa O. Cabreros, OIC-Chairperson of PCC Johannes Benjamin R. Bernabe, a designated representative from the Office of the President, and Director Generals or Chairpersons or Administrators of the IPAs, all as members of the FIRB Technical Committee; WHEREAS , the Director Generals or Chairpersons or Administrators of the IPAs whose participation in the deliberation and decision-making process is limited to the matters concerning their IPA are the following, viz. : BOI Managing Head Ceferino S. Rodolfo, PEZA OIC-Director General Tereso O. Panga, BCDA OIC-PCEO Aristotle B. Batuhan, SBMA Chairman Rolen C. Paulino, Sr., CDC PCEO Manuel R. Gaerlan, CEZA ACEO Raul L. Lambino, JHMC PCEO Allan R. Garcia, TIEZA COO Mark T. Lapid, APECO PCEO Israel F. Maducdoc, AFAB Administrator Emmanuel D. Pineda, RBOI-BARMM Chairman Ishak V. Mastura, ZCSEZA Chairman Raul M. Regondola, Felix S. Racadio, and PHIVIDEC-IA Administrator Jesus A. Manangquil, Jr.; WHEREAS , the roles and responsibilities of the FIRB Technical Committee were laid down in FIRB Resolution No. 04-21 and FIRB Resolution No. 10-21; WHEREAS , for efficiency and consistency in the performance of FIRB functions, there is a need to adopt the provisions stated in FIRB Resolution No. 04-21 and FIRB Resolution No. 12-21; DETACa NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED , that with the designation of the agency representatives, the Board approves the formal constitution of the FIRB Technical Committee; RESOLVED, FURTHER , that the roles and responsibilities of the FIRB Technical Committee laid down in FIRB Resolution Nos. 04-21, and 12-21 are hereby also adopted. RESOLVED, FURTHER , that the roles and responsibilities laid down in FIRB Resolution Nos. 04-21 and 12-21 may be modified by the FIRB members, as they may see fit; RESOLVED, FINALLY , that the FIRB Secretariat may request periodic updates from agency members in case there is a change in designations laid down herein. This Resolution may be signed in any number of counterparts, each of which, when duly executed and sent by facsimile or electronic transmission to the Secretariat, shall be valid and effectual as if executed as an original, but all the counterparts (including those sent by way of facsimile or electronic transmission) shall together constitute one and the same document.
