April 25, 1995 FIRB RESOLUTION NO. 017-95 SUBJECT : Fertilizer And Pesticide Authority (1) BE IT RESOLVED, AS IT IS HEREBY RESOLVED, to approve the application for subsidy availment of the Fertilizer and Pesticide Authority in the amount of P100,468,465 . 20 only , representing the duties due on fertilizer importations coursed through it, broken down as follows: (1) P47,842,126.21, representing the duties on fertilizer importations for the year 1994; and (2) P52,626,339.00, representing the duties on fertilizer importations for the year 1995: Provided , That the FPA shall conduct an annual fertilizer price and/or tax subsidy benefit survey/evaluation, the result of which shall be used as basis for further enhancement of the benefits derivable by fertilizer farmer-user from the tax subsidy on fertilizer importations and submit, within the first quarter of the year immediately following the year of such survey/evaluation, a report thereon to the FIRB for its own consideration: Provided , further , That the availment thereof shall be in accordance with the terms and conditions of Section 12 of the 1995 General Appropriations Act, subject to the availability of funds therefor, pursuant to the terms and conditions of the Rules and Regulations to Implement the Subsidy Provision Under Executive Order No. 93: Provided , furthermore , That the amount of tax subsidy herein granted to the FPA shall be added back to the FIRB's internal cap on tax subsidy approvals for the year 1995.
