August 14, 2009 FIRB RESOLUTION NO. 015-09 SUBJECT MATTER : National Tobacco Administration (NTA) (1) WHEREAS, the National Tobacco Administration (NTA) is mandated to improve the economic and living conditions and raise the quality of life of tobacco farmers including those who depend upon the industry for their livelihood and to promote the balanced and integrated growth and development of the tobacco industry to help make agriculture a solid basis for industrialization; WHEREAS, the NTA is gearing towards the enhancement of the competitiveness of the local leaf tobacco and other tobacco products in the global/export market and the effective regulation of the tobacco industry and to respond to the concerns on increasing public health consciousness in relation to tobacco products; TIaCcD WHEREAS, the NTA was assessed additional taxes and duties in the amount of P875,762.43 on its already billed importations in 2007 and 2008 as a result of the final assessment made by the Bureau of Customs (BOC); WHEREAS, the NTA does not have the financial capacity to assume the said taxes and duties; NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, to grant tax subsidy to the NTA in the amount of EIGHT HUNDRED SEVENTY FIVE THOUSAND SEVEN HUNDRED SIXTY TWO AND 43/100 PESOS (P875,762.43) only to cover the additional taxes and duties on its previous importations of equipment: Provided, however, that the issuance of the Certificate of Entitlement to Subsidy (CES) shall be limited to the amount of P875,762.43 only per Annex A: Provided, further, that the grant of such subsidy shall be in accordance with the terms and conditions of Section 13 of the 2009 General Appropriations Act, subject to the availability of funds therefor, pursuant to the terms and conditions of the Rules and Regulations to Implement the Subsidy Provision under Executive Order No. 93.
