October 27, 2006 FIRB RESOLUTION NO. 010-06 SUBJECT : National Food Authority (2) WHEREAS, the National Food Authority (NFA) is mandated to ensure food security and grains supply in the country and stabilize their prices; WHEREAS, the East Asian Emergency Rice Reserve (EAERR) Pilot Project was organized by the governments of Japan, China, Korea, Indonesia, Malaysia, Philippines, Singapore, Thailand, Vietnam, Cambodia, Laos PDR and Myanmar to address the emergency needs of all its member-countries at any given time such as disasters, calamities, etc.; WHEREAS, the Philippines was considered as the initial recipient of 952.46 metric tons (MT) of rice worth US$500,000.00 from Japan as the donor country which will be distributed to the affected landslide victims of Leyte and to affected areas in Mount Bulusan; WHEREAS, the subject imported/donated rice from Japan is not part of the regular rice importations of the NFA and for which reason the amount of duties due thereon is not part of the financial program of the NFA; NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, to approve the application for tax subsidy of the NFA in the amount of P17,408,720.00 only , corresponding to the duties due on the 952.46 MT of donated rice of Japan: Provided , that the initial issuance of the Certificate of Entitlement to Subsidy (CES) shall be limited to the amount of P8,704,360.00 only, representing duties due on two shipments (652.46 MT) with billings from Bureau of Customs (BOC) that arrived from July 24 to July 31, 2006: Provided further , that the subsequent CES shall be issued only upon submission by the NFA to the FIRB of the required billings and/or documents evidencing the importations with a certification that the volume covered by said billings is part of the 952.46 MT donated rice from Japan pursuant to the EAERR: Provided finally , that such availment shall be in accordance with the terms and conditions of Section 14 of the 2005 General Appropriations Act, as reenacted, subject to the availability of funds therefor, pursuant to the terms and conditions of the Rules and Regulations to Implement the Subsidy Provision under Executive Order No. 93.
