February 8, 1990 FIRB RESOLUTION NO. 009-90 BE IT RESOLVED, AS IT IS HEREBY RESOLVED, to further amend FIRB Resolution No. 7-89, as amended by FIRB Resolution No. 21-89, previously issued in favor of the Fertilizer and Pesticide Authority, as follows: "BE IT RESOLVED, AS IT IS HEREBY RESOLVED, to endorse to the Department of Budget and Management the subsidy availment of the Fertilizer and Pesticide Authority in the amount of P632,611,707 . 13 only, representing taxes and duties due therefrom on fertilizer importations released through the deferred payment scheme for the period 1983 to 1989, inclusive, as described in the accompanying Annex A of subject Resolution: Provided , That such amount shall be chargeable against the 1990 Tax Expenditures Fund, subject to the availability of funds therefor, pursuant to the terms and conditions of the Rules and Regulations to Implement the Subsidy Provision Under Executive Order No. 93: Provided , Further , That fertilizer importations made by the FPA for which Letters of Credit have been opened between January 1, 1990 and March 31, 1990 and/or which are arriving within the customs jurisdiction of the Philippines on, or before March 31, 1990, may still be considered for subsidy availment under the TEF upon application therefor, pending further review of the fertilizer situation by the FIRB, in coordination with the FPA, particularly insofar as efforts to promote the growth and development of local manufacture of fertilizers are concerned. "BE IT FURTHER RESOLVED, to amend FIRB Resolution No. 7-89 as amended and the corresponding Certificate of Entitlement to Subsidy No. 0018 therefor to reflect the foregoing." (SGD.) JESUS P.
