July 16, 2007 FIRB RESOLUTION NO. 006-07 SUBJECT MATTER : National Tobacco Administration WHEREAS, the National Tobacco Administration (NTA) is mandated to improve the economic and living conditions and raise the quality of life of tobacco farmers including those who depend upon the industry for their livelihood and to promote the balanced and integrated growth and development of the tobacco industry to help make agriculture a solid basis for industrialization; aTSEcA WHEREAS, the NTA is gearing towards the enhancement of the competitiveness of local leaf tobacco and other tobacco products in the global/export market and the effective regulation of the tobacco industry and to respond to the concerns on increasing public health consciousness in relation to tobacco products; WHEREAS, the NTA, to address these concerns, is importing different Quality Assurance Laboratory Equipment to be used to determine/analyze the presence and level of toxic and carcinogenic substance in tobacco; ACTaDH WHEREAS, the NTA does not have the financial capacity to assume the taxes and duties arising from the importation of the aforementioned equipment. NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED, to grant tax subsidy to the NTA to cover taxes and duties incurred on its importations of equipment in the amount of P3,758,060: Provided, however, that: (a) the Certificate of Entitlement to Subsidy (CES) shall be issued only upon the submission by the NTA to the FIRB of required billings and/or documents evidencing the importations; and (b) all equipment for which tax subsidy is granted shall form part of the regular inventory of the NTA (in the case of movable equipment) and/or be located in their designated project stations/operating areas (in the case of immovable equipment) as certified to by the resident Commission on Audit (COA) auditor of the NTA and its Administrator, respectively. Provided, finally , that the grant of such subsidy shall be in accordance with the terms and conditions of Section 14 of the 2007 General Appropriations Act, subject to the availability of funds therefor, pursuant to the terms and conditions of the Rules and Regulations to Implement the Subsidy Provision Under Executive Order No. 93.
