June 17, 2010 EN BANC RESOLUTION NO. 003-10 In the interest of the service and by reason of the nature of their official functions, approval of written requests for photocopies, certified true copies, examination/inspection of documents, and all other matters pertaining to a particular case, shall be acted upon by the Clerk of Court for En Banc cases and the Division Clerks of Court for cases in their respective Divisions. In the performance of this specific function, the Clerk of Court and the Division Clerks of Court shall be guided by the following rules: a) All parts of the original docket of the case must be paged and stitched; Issuance of certified true copies subject to the payment of P10.00 per page . To avoid unauthorized insertions, alterations, destructions, or tampering of court records, all pages of the original docket of the case must be paged and stitched starting from the date of the filing of the petition. As regards the issuance of certified true copies of court documents, all pages of the photocopied documents must be certified and not just a mere portion thereof. HcSETI b) Issuance of photocopies subject to the payment of P3.00 per page . Recognizing the right of the people to information and that judicial records being public documents, issuance of photocopies may be reasonably regulated or restricted but not prohibited. The requesting party must be duly identified and the purpose of the request should be indicated. Photocopies without certification may be granted to students and researchers upon presentation of proper identification . Only authorized representative of the Court should handle the reproduction of Court records. The photocopying should be done within the Court premises only. c) Inspection/Examination of records . Inspection/examination of archived cases and those above a year's standing shall be subject to the payment of P100.00, per case. Discretion is enjoined as to what documents may be inspected or examined and who will be allowed such access. The person requesting inspection/examination must identify himself and the purpose of the inspection/examination shall be clearly indicated in his written request. The inspection/examination should only be allowed in the presence of authorized Court personnel, and within a designated office in the CTA. d) Certification/Clearances . Subject to the payment of P100.00 per certification/clearance, discretion shall likewise be exercised by the Clerk of Court and the Division Clerks of Court, taking into account the party requesting the same and the purpose of the request. e) In all other instances , the Clerk of Court and the Division Clerks of Court shall exercise discretion in any request of interested persons in all other matters related to a particular case.
