Grant of Expanded Authority to the Court of Tax Appeals' Executive Clerks of Court to Issue and Sign Minute Resolutions

January 18, 2008 EN BANC RESOLUTION NO. 001-08 For purposes of exigency and speedy dispensation of justice, the Court En Banc hereby grants expanded authority (in addition to those previously granted under En Banc Nos. 01-04-05 and 01-2007) to the Court of Tax Appeals' Executive Clerks of Court (Clerk of Court, Assistant Clerk of Court and the Division Clerks of Court), to issue and sign Minute Resolutions relative to the following pleadings/submissions filed by litigants both in the Division and En Banc levels, to wit: 1. Resolving motions to amend caption of the case if there is no extended Resolution issued by the ponente (for completion) and on the basis of the action voted upon by the Court En Banc in the Agendum as reported by the Clerk of Court; 2. Monitoring compliance with the formal requirements as provided under Section 6, Rule 6 of the Revised Rules of the CTA which requires the indication in the pleadings of the following: a) Counsel's Roll of Attorney Number; b) Date and number of his current membership due in the Integrated Bar of the Philippines (IBP) per Official Receipt, or Lifetime Member Number; c) Current Professional Tax Receipt (PTR) number together with the date and place of issuance; and d) MCLE certificate number and date of issue, unless exempt; and e) Monitoring compliance with the requirement of verification and certification against Forum Shopping after non-compliance therein is reported by the Clerk of Court by way of an Agendum to the ponente (for completion) for appropriate action.
