DOJ OPINION NO. 255 , s. 1988 3rd Indorsement December 29, 1988 Respectfully returned to the Assistant Executive Secretary for Legal Affairs, Malacaang, Manila, his within request "for comment and recommendation" on the request of Mr. Gregorio A. Sanchez of Junten Commercial Resources, Inc. for clarification as to whether the ban against the importation of used tires pursuant to LOI NO. 1986 has been repealed by Republic Act No. 6647, together with the statement that this Department is constrained to refrain from expressing its views on the matter since it involves a question of economic policy. It is noted that the Inter-Agency Committee on Used Trucks and Engines has previously denied Mr. Sanchez's request for importation of 120 thousands units of used bus/trucks tires and said denial was apparently based, principally on socio-economic grounds. Moreover, R.A. No. 6647 (which restructures the import duty rates and classification of certain articles under Section 104 of the Tariff Code) is an economic legislation and this Department is not conversant with the policy implications in the implementation of said office. cdphil Very truly yours, (SGD.)
