Carlo A. Carag, Undersecretary for Revenue Operations and Legal Affairs Group. Please be informed that, henceforth, this Office will require applicants under Contract with Department of Energy (DOE) to present a Certification from Philippine Chamber of Commerce and Industry (PCCI) or the Federation of Philippines, Inc. (FPI) to the effect that the product/s to be imported are not locally available and that the same are not available in sufficient quantity, of comparable quality and at a reasonable price. MARIANO Director IV, Revenue Office ATTACHMENT OFFICE ORDER NO. 55-2010 October 12, 2010 In the exigency of the service, the following shall be observed by the Revenue Office (RO) in the matter of obtaining a certification as required by law, rule or regulation, for purposes of applying for tax/duty free importations, that an article to be imported is not locally available in sufficient quantity, of comparable quality and at a reasonable price : ISCDEA 1. A certification from the Board of Investments (BOI) -Department of Trade and Industry shall be deemed sufficient compliance. 2. Where a particular law/regulation upon which the claim of entitlement is based indicates a specific agency or office as the certifying authority (and the article of importation is not among those over which the BOI grants certifications), a certification from that specific agency or office shall be necessary. In addition thereto, however, another certification from either of the Philippine Chamber of Commerce and Industry (PCCI) or the Federation of Philippine Industries, Inc. (FPI) , shall be required. 3. Absent the required certification/s, action on the request for tax/duty exemption shall be held in abeyance until the required document/s is/are obtained.
