October 17, 1989 DOF LOCAL FINANCE CIRCULAR NO. 01-89 TO : The Regional Director, this Bureau; the Commissioner for Finance, Metropolitan Manila Commission; Provincial Governors, City and Municipal Mayors; Members of Local Sanggunians; Provincial, City and Municipal Treasurers and Assessors; and Others Concerned It has come to the knowledge of this Department that despite the expiration on March 31, 1987 of the period prescribed for the one-time real property tax amnesty pursuant to Executive Order No. 42, dated August 22, 1986, as amended by Executive Order No. 104, dated December 24, 1986, both of the Office of the President, provincial and city treasurers are still reluctant to advertise, pursuant to Section 73 of PD No. 464, as amended, the sale at public auction of delinquent real properties. The reluctance, it seems, stems from the provisions of Section 2 of the abovestated Executive Order No. 42, which read as follows: "No public auction of delinquent real properties shall be held during the period of this amnesty." Considering that the tax amnesty has ended on March 31, 1987, provincial and city treasurers can now resume the sale at public auction of all delinquent real properties not covered by the compromise agreements allowed by the abovementioned Executive Orders, subject, however, to the conditions set forth under Section 73 of Presidential Decree No. 464, as amended, otherwise known as the Real Property Tax Code. Such activity may enhance the attainment of the property revenue targets set forth for each local government unit for the current calendar year. All local treasurers, however, should seek the approval of their respective Governors and Mayors for the conduct of said auction sales. The Regional Directors of this Bureau, the Commissioner for Finance, Metropolitan Manila Commission, and the Provincial Treasurers and Assessors are hereby enjoined to reproduce and distribute copies of this Circular to the Local Chief Executives and the Municipal Treasurers and Assessors within their respective jurisdictions.
