September 23, 2013 DOF DEPARTMENT ORDER NO. 054-13 ( Declared Overtaken by Events by D.O. 29-16 ) WHEREAS, in Roque, et al. vs. Office of the Executive Secretary, et al. , docketed as Case No. 06-203, pending before Branch 145 of the Regional Trial Court of Makati City (the "Case"), plaintiffs therein seek to nullify and enjoin the implementation of the Buyer Credit Loan Agreement No. BLA 04055 dated 26 February 2004 between the Government of the Republic of the Philippines and the Export-Import Bank of China (the "Loan Agreement"). TSacID WHEREAS, the Department of Finance (DOF) is impleaded therein as a party defendant. WHEREAS, the Bureau of the Treasury, an attached agency under the DOF, has the mandate, among others, to manage the cash resources of the National Government and service public debt, both foreign and domestic. In view of the foregoing, I hereby designate and authorize the following officials of the Department of Finance: a. to cause the filing of, and to sign, on behalf of the DOF, any and all pleadings, motions, verifications, certifications, and other papers in connection with the Case, including the Response to the Plaintiffs' Request for Admission dated 22 April 2013: Treasurer Rosalia V. De Leon b. to file an affidavit and to appear as witnesses, on behalf of the DOF, in the court proceedings of the case to provide information on matters pertaining to the procedures of availing Official Development Assistance (ODA) loans and the Loan Agreement: Treasurer Rosalia V.
