December 7, 2010 DOF DEPARTMENT ORDER NO. 050-10 REQUIRING THE COMMISSIONER OF INTERNAL REVENUE AND COMMISSIONER OF CUSTOMS TO TRANSMIT ALL DECISIONS IN ALL GRAFT-RELATED CASES TO THE SECRETARY OF FINANCE This Department Order is being issued pursuant to the Department's commitment to promote transparency in the conduct of investigating its personnel. Thus, it is necessary that the laws and procedures in all graft-related cases in the Bureau of Internal Revenue and Bureau of Customs be strictly complied with. Hence, pursuant to its mandate under Executive Order (EO) No. 259, series of 2003, the Revenue Integrity Protection Service (RIPS) shall review said cases to determine their compliance with existing laws and procedures, and liability, if any, of concerned officials. TIDHCc SECTION 1. Mandatory Transmittal and Coverage. The Commissioner of Internal Revenue and Commissioner of Customs are hereby mandated to transmit to the Secretary of Finance all decisions dismissing graft-related cases including, but not limited to, the following: 1. Offenses under Republic Act No. 3019; 2. Offenses under Republic Act No. 6713; 3. Offenses classified as Grave Offenses under the Civil Service Rules and Regulations; 4. Other similar offenses SECTION 2. Compliance Period. The Commissioners or his/her duly authorized representative shall submit all decisions dismissing the case together with the entire docket, to the Office of the Secretary within fifteen (15) days from the date of approval of the said decision. The Commissioners or his/her duly authorized representative shall likewise furnish the Executive Director of RIPS a copy of said docket. SECTION 3. Separability Clause. If for any reason, any section or provision of this Department Order be declared invalid; such parts which are not affected shall remain in full force and effect. SECTION 4. Repealing Clause. All orders, circulars, memoranda, and other issuances, or parts thereof, which are inconsistent with this Department Order, are hereby repealed or modified accordingly. SECTION 5. Effectivity.
