August 30, 2007 DOF DEPARTMENT ORDER NO. 034-07 SUBJECT : Creation of Property Valuation Staff (PVS) and Reconstitution of the LAMP 2 Component 4 Project Management Office (PMO) Pursuant to the Loan Agreement between the World Bank and the Government of the Philippines under the Land Administration and Management Project Phase 2 (LAMP 2 Loan No. 7298-PH), a Property Valuation Staff (PVS) is hereby created and the Project Management Office (PMO) organized under Department of Finance (DOF) Order No. 30-06, dated March 1, 2007 is likewise hereby reconstituted: SECTION 1. Property Valuation Staff (PVS) . The Property Valuation Staff shall be headed by an Acting Director and composed of the following units: a) Policy and Legislative Advocacy Unit (Legislative Advocacy-BLGF and Taxation Policy-NTRC) ; b) Valuation Database and IT Unit ; c) Valuation Standards Unit (Standards Development-BLGF and Simulation Studies-NTRC) ; and d) Valuation HRMD (Education and Training) Unit . These units shall be taken from the LAMP 2-Component 4 PMO created under DOF Order No. 30-06. The remaining units of the PMO, namely: Finance; Administration; and Planning, Monitoring and Evaluation Units shall continue to provide their respective services to the PVS. A Coordinator for the PVS shall be designated to ensure proper and coordinated flow of functions among all the PVS units. To accelerate the implementation of valuation reform activities and to strengthen the capacity of each of the PVS units and the entire PVS, consultants and staff shall be hired until the Valuation Reform Act (VRA) is effective and funds therefor are provided for its operation. The PVS Acting Director shall determine on an annual basis the adequacy of the staffing pattern of the PVS, and any changes therein shall be approved by the LAMP 2 Component 4 Project Manager and the Management Committee (ManCom). HSAcaE The Taxation Policy and Simulation Studies organized at NTRC shall be integral parts of the PVS for as long as simulation, taxation studies and other research activities are deemed necessary in the furtherance of valuation reforms, prior to the establishment of the National Valuation Authority (NVA). Considering the importance of property valuation reforms to the national, as well as, to the local (LGU) economies and pending the passage and approval of the VRA, the PVS shall remain to ensure that valuation reforms are undertaken. In the event that LAMP 2 or subsequent projects under the LAM Reform Program of the Government are terminated, the PVS shall continue its functions under the supervision of the DOF or its assigned agency, with the required annual budget sought through the General Appropriations Act (GAA). The PVS shall also initiate the formation of the Regional Property Valuation Unit (RPVU) , initially in Region VI (Western Visayas) and in other regions, as may be deemed necessary and feasible. The PVS shall determine the interim composition of the RPVU which shall be the core of the envisaged NVA in the regions when the VRA is approved and implemented. SECTION 2. Organization and Functions of the PVS . The PVS shall be under the supervision of the LAMP 2 Component 4 Project Manager and the ManCom (or their equivalent in subsequent LAM Reform Projects). The LAMP 2 Component 4 PMO (and subsequent projects) shall provide facilitative and coordinative support to the PVS. In the interim, additional consultants and contractual staff shall be hired to support the PVS and the PMO. The Department of Finance (DOF) shall undertake to request from the Department of Budget and Management (DBM) for permanent positions of the PVS which shall be transferred to the plantilla of the NVA once the VRA is passed and approved. In the interim, the PVS shall define the structure and functions of the RPVU for approval by the ManCom. SECTION 3. Role of the Management Committee (ManCom) . The ManCom of LAMP 2 Component 4 (or subsequent projects under the LAM Reform Program) shall provide policy guidance to the PVS and the PMO until the approval and implementation of the VRA. SECTION 4. Reports . The PVS shall accomplish the reports as prescribed by LAMP 2 Monitoring and Evaluation System. Such reports shall cover both physical and financial progress, issues and recommendations. The ManCom shall furnish the consolidated PVS reports to the Secretary of Finance on a semestral basis. The Planning, Monitoring and Evaluation Unit of the PMO shall assist in the formulation of a planning, monitoring and evaluation system for the PVS, that shall eventually become the operating system for the NVA. HESIcT SECTION 5. Fund Sources . The funds required for the operation of the PVS under this Order shall be sourced from the funds of LAMP 2 and subsequent projects under the LAM Reform Program of the Government. Fund requirements in case of termination or discontinuance of projects under the LAM Reform Program shall be sourced through the GAA. SECTION 6. The Reconstituted Project Management Office (PMO) . As a result of the creation of the Property Valuation Staff (PVS), the LAMP 2 Component 4 PMO shall be reconstituted, to be composed of the Office of the Project Component Manager; Planning, Monitoring and Evaluation Unit; Finance Unit; and Administration Unit. The Executive Director of BLGF shall remain the Project Component Manager and the Executive Director of NTRC shall likewise remain the Deputy Project Component Manager. The Deputy Executive Director for Administration of BLGF shall be designated PMO Coordinator. The Planning, Monitoring and Evaluation Unit shall initiate the development of a Monitoring and Evaluation System particularly on the aspect related to the compliance reporting of LGUs. The Project Component Manager through the PMO Coordinator shall be responsible in providing administrative, financial, and planning, monitoring and evaluation support to the PVS. The technical operation of the PVS, however, shall remain with the PVS Acting Director. In the event of discontinuance of projects under the LAM Reform Program, the PMO shall cease to exist. However, DOF or its assigned agency (BLGF) shall continue to provide administrative and financial services to the PVS. Further, the PVS may constitute its own Planning, Monitoring and Evaluation Unit including the hiring of requisite staff. SECTION 7. Staff Compensation . The officers and staff of BLGF and NTRC assigned to the PVS and the PMO shall be entitled to honoraria and overtime pay in accordance with the guidelines issued by the ManCom pursuant to the General Appropriations Act. SECTION 8. Annexes to this Order . Annex A hereof embodies the schedule of staffing assignment (BLGF and NTRC), including the consultants and contractual staff to be hired. Annex B hereof embodies the organizational structure of the PVS, while Annex C hereof embodies the functions of the PVS. Annex D hereof embodies the composition of the PMO. All annexes mentioned shall form an integral part of this Order. SECTION 9. n Effectivity . This Department Order supersedes all other Orders issued which are inconsistent herewith, and shall be effective immediately. Policy and Legislative Advocacy Unit . The Policy and Legislative Advocacy Unit shall be responsible for the following: Policy and Legislative Advocacy Sub-unit a. Redrafting of the VRA and RESA bills; b. Build consensus of stakeholders; c. Facilitation of legislative processes related to VRA and RESA Bills; d. Formulation and implementation of advocacy strategy related to legislative processes for the VRA and RESA and implementation of the approved bills; e. Formulation of policies related to the pre and post legislation of the VRA and the implementation and operation of the NVA; and f. Assist in the transition and implementation of the VRA and RESA. Taxation Policy Sub-unit a. Review of land taxes, fees and charges collected by the national and local governments; b. Propose measures to rationalize land related taxes, fees and charges; c. Formulate and implement advocacy strategies relative to tax and valuation policy reforms; d. Review the implications of proposed tax policies arising from the results of the valuation simulation study being undertaken in the pilot LGUs; and e. Facilitate and support consultations/consensus building activities relative to tax policy reforms. B. Valuation Standards Unit . The Valuation Standards Units, composed of the Valuation Standards Development Sub-unit and the Simulation Studies Sub-unit, shall be responsible for the following: Valuation Standards Development Sub-unit a. Assist in the formulation and roll-out of standards and handbooks including the formulation of implementing guidelines for the new valuation standards; b. Initiate the formation of Special Properties Unit (SPU) by determining the potential demand for special purpose properties appraisal and the optimal size of the SPU at the NVA; c. Coordinate with NTRC on the simulation and taxation studies and formulate strategies and recommendations based on these activities; d. In conjunction with the Policy and Legislative Advocacy Unit, formulate and implement an advocacy plan for the adoption of standards by LGUs and other stakeholders. Simulation Studies Sub-unit a. Demonstrate the application of the valuation standards including appropriate mass appraisal techniques and procedures in the revision of the Schedule of Market Values of the LGU partners; b. Organize workshops and training programs related to the application of the valuation standards; c. Develop and maintain a Valuation Handbook to be used as basis for training; d. Conduct simulation studies on the implication of the valuation standards on the values of properties and on the revenues of the LGU partners; e. Assist in advocacy and community awareness programs and implement PR strategy to build understanding and support of the valuation standards; f. Coordinate and liaise with simulation LGU partners on matters related to simulation studies. C. Valuation Database and IT Unit a. Assist in the formulation of information systems for real property transactions database; b. Coordinate with NTRC on the conduct of simulation and taxation studies to ensure that information requirements and the corresponding results generated from these studies are captured in the database; c. Assess the IT capacity of LGUs and formulate strategy for adoption of database by LGUs; and d. In conjunction with the HRMD Unit, assist in the conduct of training programs related to the adoption of real property transactions database. D. Valuation HRMD (Education and Training) Unit a. Assist in the implementation of change management plan as agreed upon between BLGF and SEARCA; b. Based on the training needs analysis (TNA) for the valuation sector, formulate training programs for key stakeholders, particularly the LGUs; c. Assist in the design, conduct of training, and evaluation for the PVS personnel; and d. Based on the results of education efforts under Component 2, facilitate the adoption of training education program by partner universities.
