October 6, 2004 DOF DEPARTMENT ORDER NO. 029-04 ( Declared Overtaken by Events by D.O. 29-16 ) DESIGNATING DIR. THELMA A. MARIANO, VICE DIRECTOR PORFIRIO B. VILLENA AS CHAIRMAN OF THE TASK FORCE THAT HANDLES THE RECONSTITUTION OF ALL CERTIFICATES OF TITLE TO REAL PROPERTY OF THE EIIB Director Thelma A. Mariano, Vice Director Porfirio B. Villena, is hereby designated as Chairman of the Task Force that handles the reconstitution of all certificates of title to real property of the Economic Intelligence and Investigation Bureau (EIIB). The Task Force shall now be composed of the following: Atty. Thelma A. Mariano, LAO - Chairman Atty. Pancho Garong, CMIO - Member Mr. Rommel Formaran, LAO - Member The respective Regional Director of BLGF where the property is located. - Member (Provisional) Under this designation, the above-named shall prepare and prosecute the necessary legal actions to reconstitute EIIB certificates of title preparatory to their transfer to and titling in the name of this Department. The Chairperson is hereby authorized to sign all petitions for reconstitution and other related pleadings that may be filed by the Task Force. The Task Force shall file all petitions for reconstitution of EIIB properties within the second month from the issuance of this Department Order. It shall ascertain that all petitions shall contain the jurisdictional facts required for judicial and/or administrative reconstitution of title, as the case may be. It shall also ensure that all posting and publication requirements are fulfilled. The Chairperson or her designated representative shall represent this Department in all hearings on the matter. Travel to the Regional Trial Courts where the subject properties are located must be preceded by a Travel Order and an Order of the respective courts requiring a representative of this Department to attend a hearing on the matter. Pursuant to Rule 13, Sec. 11 of the Revised Rules of Court, service and filing of pleadings outside of the Metro Manila area shall be done through registered mail due to distance and lack of messengerial personnel. Permanent Members of the Task Force shall coordinate with Provisional Members for gathering of information and for matters that require the presence of a Member of the Task Force in the place where the property is located. For this purpose, the BLGF Executive Director is mandated to provide the proper instruction to and monitor the compliance of the Provisional Members. The Chairman shall file monthly reports indicating the accomplishments of the Task Force within ten (10) days after the end of each month, beginning the first month from the issuance of this Department Order, and submit the same to the Undersecretary, Policy Development and Management Services Group and the Undersecretary, Revenue Integrity Protection Services, who shall provide the Task Force with supervision and instruction. SCaITA This Order, which amends Department Order No. 299-02 dated October 28, 2002, shall take effect immediately and shall remain in force until otherwise rescinded or modified. (SGD.) NIEVES L.
