Suspension of LGU Imposition and Collection of Illegal Fees and Taxes

October 12, 2011 DILG MEMORANDUM CIRCULAR NO. 151-11 TO : All Provincial Governors, City Mayors, Municipal Mayors, Punong Barangays, DILG Regional Directors and Others Concerned SUBJECT : Suspension of LGU Imposition and Collection of Illegal Fees and Taxes In the meeting of the President with the transport sector on 14 September 2011, it was reported that LGUs are still imposing and collecting illegal fees and taxes particularly on trucks and similar motor vehicles passing thru their jurisdiction. CaSHAc Pursuant thereto, the President instructed the Department to ensure that LGUs' are not imposing and collecting pass through fees and other illegal collections. In view thereof, and pursuant to Section 133 (e) of the Code, all local chief executives are hereby enjoined to: (1) refrain from enforcing any existing ordinance authorizing the levy of fees and taxes on inter-province transport of goods, regulatory fees from passengers in local ports, and other additional taxes, fees or charges in any form upon transporting goods and passengers; and (2) cause the immediate repeal of the ordinance imposing the abovecited fees and taxes. ITCcAD All DILG Regional Directors are likewise hereby enjoined to cause the immediate and widest dissemination of this Memorandum Circular within their regional assignment, and to report to the Office of the undersigned non-compliant/violators of this directive for the institution of appropriate cases against those concerned officials.
