Computation, Assessment, Demand and Collection of Franchise and Real Estate Tax from DCWD and Other Government Agencies in Davao City

October 15, 2004 DAVAO CITY ORDINANCE NO. 026-04 AN ORDINANCE DIRECTING THE CITY TREASURER TO COMPUTE, ASSESS, DEMAND AND COLLECT FROM DAVAO CITY WATER DISTRICT (DCWD) AND ALL OTHER NATIONAL GOVERNMENT AGENCIES INCLUDING GOVERNMENT-OWNED AND CONTROLLED CORPORATIONS (GOCCs) OPERATING WITHIN DAVAO CITY, FRANCHISE TAX AND REAL ESTATE TAX DUE TO THE CITY GOVERNMENT OF DAVAO IN ACCORDANCE WITH R.A. 7160, OTHERWISE KNOWN AS THE LOCAL GOVERNMENT CODE OF 1991 Be it ordained by the Sangguniang Panlungsod of Davao City in session assembled that: SECTION 1. Title . This Ordinance shall be known as "An Ordinance directing the City Treasurer to compute, assess, demand and collect from Davao City Water District (DCWD) and all other national Government agencies including Government-Owned and Controlled Corporations (GOCCs) operating within Davao City, franchise tax and real estate tax due to the City Government of Davao in accordance with RA 7160, otherwise known as the Local Government Code of 1991; SECTION 2. Purpose . This Ordinance is hereby ordained for the following purpose and objectives, to wit: a. To generate funds for the maintenance of efficient public service and sustain its development and growth; b. To collect revenues in the form of local taxes, fees and charges from all individual and corporate taxpayers including Government-Owned and Controlled Corporations (GOCCs) in accordance with Sections 132, 137, 200, 216, 218 (d) 222 of R.A. 7160; SECTION 3. Collection and Demand of Taxes . The City Treasurer is hereby directed to compute, assess, demand and collect from Davao City Water District (DCWD), and all other national government agencies including Government-Owned and Controlled Corporations (GOCCs) franchise tax, and real estate tax due to the City Government of Davao in accordance with Sections 132, 137, 200, 216, 218 (d) and 222 of R.A. 7160; SECTION 4. City Treasurer's Report . The City Treasurer is hereby directed to render a report to the Sangguniang Panlungsod as to the final amount due from the Davao City Water District within thirty (30) days after approval of the Ordinance; SECTION 5. Repealing Clause . Any provision existing Ordinances inconsistent with the provisions of this Ordinance is hereby repealed accordingly; cdtax2005 SECTION 6. Effectivity .
