October 31, 2004 DAVAO CITY ORDINANCE NO. 024-04 AN ORDINANCE IMPLEMENTING A SINGLE REGISTRATION FORM AND A ONE-STOP SHOP CENTER PROCEDURE FOR THE WHOLE YEAR IN THE REGISTRATION OF BUSINESS PERMITS Be it ordained by the Sangguniang Panlungsod of Davao City in session assembled that: SECTION 1. Title . This Ordinance shall be known as "An Ordinance Implementing a Single Registration Form and a One-Stop Shop Center Procedure for the Whole Year in the Registration of Business Permits; SECTION 2. Declaration of Policy . It is hereby declared as a policy of the City Government to rationalize its bureaucracy specially in the granting of permits to business investors and entrepreneurs in order to boost economic growth and provide jobs to its constituents; SECTION 3. Purposes/Objectives . This Ordinance shall have the following purposes and objectives, to wit: a. To promote registration of more businesses thereby increasing local revenues for the City Government to support and subsidize the growing needs of its residents; b. To pave the way for the creation of new jobs with social benefits or insurances; c. To discourage and regulate the emergence of the so-called "underground economy" especially on short-term or seasonal businesses; SECTION 4. Single Registration Form . It is hereby ordained that: 1. All businessmen applying for business permit in the Mayor's Office shall fill up a Registration Form provided for the purpose stating the Name of the Establishment, Business Address, Purpose or Objective of the Business, Amount of Capitalization, and the Name of Owner/Proprietor; 2. Said registration form shall also provide the terms and conditions required by the City Government with regards to the allowable activities as well as the prohibited ones all embodied in the face of such form to be concurred by the applicant and duly approved by the various departments/offices mandated by law to give clearances or certifications as to the approval of the said registration. Once approved by the City Mayor or his authorized representatives, the registration form shall now serve as business permit granting the owner/proprietor the privilege to do the business activities stated therein; 3. There shall be only one business activity allowed for each business permit regardless of whether or not such is allied to the main business. In case of allied activities or services the owner/ operator shall be required to apply for another business permit stating clearly its purpose; 4. The said registration from must then be kept in the premises of the establishment where the business is operating for inspection purposes. Such permit may be cancelled or revoked pursuant to law or when public safety and welfare so demands. SECTION 5. One-Stop Shop Procedure . There shall be a One-Stop Shop Procedure in the issuance of business permits as follows: 1. One-Stop Shop Center (OSSC) The City Mayor's Office, Business Bureau, together with all other city offices in charge of giving clearances before the issuance of permits shall put up a One-Stop Shop Center, hereinafter called OSSC, at the ground floor of the Sangguniang Panlungsod Building, and in all other district halls as the need arises, during office hours all throughout the year for the purpose of making available to the taxpayers a speedy, efficient and convenient tax paying process in the City; 2. Deputized Representative The Chief of Office concerned shall provide their respective deputized representatives who shall stay within the premises of said OSSC and install their cubicle/table thereat so as to expeditiously approve or grant clearances to applicants for business permits; 3. Business Center/ Taxpayer Assistance Center The OSSC shall also provide a Business Center/ Taxpayer's Assistance Center that will cater to the common problems encountered by the taxpayers or establishment owners in the course of theft application; 4. The OSSC shall be opened between 8:00 to 5:00 p.m. from Monday to Friday the whole year round except on national and legal holidays; 5. The OSSC participating departments/offices shall act immediately on the application papers submitted to their level and shall advise the taxpayer the soonest of any deficiency on their application. Each office is required not to delay such clearances or approval beyond 30 minutes from the time it is officially submitted to their attention, unless there is a good reason to do so; 6. The OSSC department/office personnel shall evolve a fast, efficient and convenient processing of all business permits/registration as they see fit in the interest of public service; SECTION 6. Separability Clause. Any provision of this Ordinance that shall later on be rendered null and void by a competent court shall not affect the remaining provisions of this Ordinance that are valid and constitutional; SECTION 7. Repealing Clause . Any provision of existing Ordinances inconsistent with the provisions of this ordinance is hereby repealed accordingly. ASaTCE SECTION 8. Effectivity . This Ordinance shall take effect immediately after its publication as required by the provisions of R.A. 7160 otherwise known as the Local Government Code of 1991; ENACTED, September 21, 2004 by a majority vote of all the Members of the Sangguniang Panlungsod.
