Encabo WHEREAS, the Luzviminda II Wet and Dry Market is one of the public markets in the Municipality of Dasmarias, Cavite that is operated by the Office of the Economic Enterprise Development and Management; WHEREAS, there is a necessity to collect fees in Luzviminda II Wet and Dry Market for the continuance of its operation; NOW THEREFORE, on joint motion of Sangguniang Bayan Member Raul Rex D. Mangubat and Sangguniang Bayan Member Cecilio R. Dedase, Jr. duly seconded by all Sangguniang Bayan Members present, BE IT ORDAINED AS IT IS HEREBY ORDAINED by the Sangguniang Bayan in a session duly assembled, that: SECTION 1. Title . This Ordinance shall be known as "TAX ORDINANCE PRESCRIBING FEES AT THE LUZVIMINDA II WET AND DRY MARKET". SECTION 2. Supervision and Control . The Municipal Market Supervisor who is under direct supervision and control of the Municipal Mayor shall enforce the provisions of this Ordinance and other rules and regulations governing the operations of the said wet and dry market. SECTION 3. Prescribed Fees. The electrical consumption is based on wattage of lighting each stall has and other devices being used that consumes electricity. SECTION 4. Collection of Fees. Collection of stall fees, maintenance, water and electrical consumption per stall shall be the responsibility of the Treasurer in coordination with the Office of the Municipal Administrator. To ensure that such responsibility is properly and effectively discharged all market collectors including other personnel involved in collection functions shall directly be under the control of the Treasurer and Administrator. SECTION 5. Separability Clause. If for any reason, any section or provision of this Ordinance is declared illegal or unconstitutional, other sections or provisions hereof shall continue to be in full force and effect. SECTION 6. Repealing Clause. All municipal ordinances, rules and regulations or parts thereof, which provisions are in conflict with, or contrary to the provisions of this Ordinance are hereby repealed, amended, and modified accordingly. SECTION 7. Effectivity Clause. This Ordinance shall take effect thirty (30) days after its posting at the bulletin boards of the Municipal Government and publication in a newspaper of local circulation. UNANIMOUSLY APPROVED.
