Approving the Recommendations of the 2nd Executive Committee in Its Resolution No. 1, Series of 2023, Dated 16 October 2023

November 6, 2023 CTA EN BANC RESOLUTION NO. 5-2023 APPROVING THE RECOMMENDATIONS OF THE 2ND EXECUTIVE COMMITTEE IN ITS RESOLUTION NO. 1, SERIES OF 2023, DATED 16 OCTOBER 2023 WHEREAS , on February 9, 2022, the Court of Tax Appeals (CTA) and the Department of Public Works and Highways-National Capital Region (DPWH-NCR) entered into a Memorandum of Agreement (MOA) for the full implementation of the construction of a Six (6)-Storey Building with One (1) Basement Parking or the CTA Building III (hereinafter called the "Project"); EcTCAD WHEREAS , pursuant to the aforesaid MOA, the DPWH-NCR was tasked to conduct the Project's procurement activities; WHEREAS , the DPWH-NCR conducted a public bidding for the said Project and awarded the same to St. Gerrard Construction General Contractor & Development Corporation (St. Gerrard); WHEREAS , under the Contract Agreement executed by and between the DPWH-NCR and St. Gerrard on July 11, 2022, the Project should be completed within five hundred forty (540) calendar days; WHEREAS , the DPWH-NCR issued a Notice to Proceed dated July 18, 2022 which was received by St. Gerrard on July 22, 2022; WHEREAS , pursuant to the Contract Agreement, the Project completion date is January 13, 2024; WHEREAS , the Revised Bar Chart Diagram/Financial Curve Diagram (Due to Contract Time Extension No. 2) prepared and submitted by St. Gerrard shows that actual construction started in July 2022 and is set to be fully completed by March 2024; WHEREAS , the 2nd Executive Committee (Execom) issued Resolution No. 1, Series of 2023, recommending the following: (1) the amendment of CTA Administrative Order (AO) No. 08-2022 dated March 21, 2022 and CTA En Banc Resolution dated January 24, 2023 to appoint Engr. Raul A. Rayo, Supervising Judicial Staff Officer, General Services Division (GSD), vice Engr. Leopoldo P. Pablo II, as the CTA's sole representative under Part C (3) of the MOA in all matters relating to the Project and to grant him the authority to issue and sign letters and correspondences addressed to the DPWH-NCR, Arce Bailon Arce Architects (ABAA), other government agencies, and St. Gerrard; (2) the issuance of a separate AO to designate Mr. Allan B. Demeterio, Security Guard III, Security Services Unit (SSU), and Mr. Alexander N. Cusipag, Security Guard III, SSU, as assistants to Engr. Rayo to ensure close monitoring of the implementation and completion of each phase of the Project; and SDHTEC (3) the issuance of a separate AO to reconstitute the Execom and its Secretariat and TWG by designating: (1) as Execom Member, Associate Justice Henry S. Angeles vice Associate Justice Erlinda P. Uy (Ret.); (2) a substitute TWG Member, vice Engr. Leopoldo P. Pablo II, CJSO, GSD, chosen from among the staff of Associate Justice Henry S. Angeles; (3) as Secretariat Head, Atty. Ela A. Sangalang, Executive Assistant VI-CT, OAJMIRF vice Atty. Char Therese R. Edillor-Vallente, Court Attorney V-CT, OAJJMBV; (4) as Secretariat Member, Ms. Gloria A. Laxamana, Court Stenographer IV-CT, vice Mr. Rieland J. Cuevas, Executive Assistant V-CT, OAJJMBV; and (5) as additional Secretariat Member, the aforesaid staff of Associate Justice Henry S. Angeles. WHEREAS , to ensure the close monitoring and timely completion of the Project, the Court deems it appropriate to reconstitute the composition of the Execom, its Secretariat and Technical Working Group; delineate the responsibilities of the officers of the GSD; and, assign additional tasks to certain personnel of the SSU, GSD; NOW THEREFORE , the Court En Banc RESOLVES , as it is hereby RESOLVED , to APPROVE CTA Administrative Order No. 32-2023 reconstituting the Executive Committee, its Secretariat and Technical Working Group, and CTA Administrative Order No. 33-2023 delineating the responsibilities of the officers of the GSD and assigning additional tasks to certain personnel of the SSU, GSD.
