Vailoces Member ABSENT: None RESOLUTION NO. 931-93 The Sangguniang Panlungsod of the City of Cebu, on motion of Member Holganza, seconded by Member Aznar, RESOLVED, to approve the following City Tax Ordinance: CITY TAX ORDINANCE NO. LXXI AN ORDINANCE AMENDING SECTION 44 OF ORDINANCE NO. LXIX OTHERWISE KNOWN AS "THE REVISED OMNIBUS TAX ORDINANCE OF THE CITY OF CEBU" WHEREAS, Section 44, second paragraph, of "The Revised Omnibus Tax Ordinance of the City of Cebu" makes the holding of athletic games, meets and other sports competitions taxable if these are held primarily for fund-raising purposes unless the same are sponsored by educational institutions, the Philippine Amateur Athletic Federation, the Basketball Association of the Philippines or the Philippine National Red Cross; WHEREAS, recognizing the importance of developing sports within the City of Cebu, the Sangguniang Panlungsod enacted Ordinance No. 1424 creating the Cebu City Sports Commission; WHEREAS, in cognizance of the limited financial resources of the city, Section 4 (II) was incorporated in the aforesaid Ordinance No. 1424 empowering the Cebu City Sports Commission to periodically conduct fund-raising activities to help finance its various projects and programs; WHEREAS, there is a need to amend the aforecited provision of "The Revised Omnibus Tax Ordinance of the City of Cebu" to be reflective of the intent of the Sangguniang Panlungsod of the City of Cebu and to enable the Cebu City Sports Commission to raise the much needed revenues to finance its projects and programs. aTEACS NOW, THEREFORE, for and in consideration of the foregoing premises, the Sangguniang Panlungsod of the City of Cebu, assembled together in session, hereby ordains that: SECTION 1. Section 44, 2nd paragraph of "The Revised Omnibus Tax Ordinance of the City of Cebu" is hereby amended in order to read as follows: "Athletic games or meets and competitions such as basketball games, boxing exhibitions and bouts are taxable if such games, athletic meets or exhibitions are held primarily for fund-raising purposes, unless they are held under the auspices of or sponsored by educational institutions, by the Philippine Amateur Athletic Federation (PAAF); by the Basketball Association of the Philippines (BAP); by the Philippine National Red Cross (PNRC); by the Cebu City Sports Commission (CCSC); by the Federation of the Association of Barangay Councils (FABC); and by the SK Federation; PROVIDED, HOWEVER, That all the amusement taxes collected from athletic games, meets or exhibitions which are held primarily for fund-raising purposes and are not exempted from payment of such tax, shall inure exclusively for the benefit of the Cebu City Sports Commission." SECTION 2. This ordinance shall take effect immediately upon its approval. CARRIED UNANIMOUSLY. I hereby certify to the correctness of the afore-quoted resolution. (SGD.) ESTRELLA F.
