Cuenco Member (On Leave) RESOLUTION NO. 12-4074-12 The Sangguniang Panlungsod of the City of Cebu, as moved by Member Dizon and seconded by Member Pe Jr.; RESOLVED, to approve the following Ordinance: CEBU CITY TAX ORDINANCE NO. CXXVIII "AN ORDINANCE FURTHER AMENDING CHAPTER XVIII SECTION 67 (i) (6) & (7) OF CITY TAX ORDINANCE NO. LXIX, AS AMENDED, OTHERWISE KNOWN AS 'THE REVISED OMNIBUS TAX ORDINANCE OF THE CITY OF CEBU'" WHEREAS, all Socialized Housing beneficiaries who pay their monthly amortizations are provided with Official Receipts which need to be certified true and correct by the Office of the City Treasurer of Cebu, per requirement of the Division for the Welfare of the Urban Poor as proof of payment; WHEREAS, there is a need for the Office of the City Treasurer of Cebu to certify the Official Receipts of Socialized Housing beneficiaries as true and correct after it was found out that some of these Official Receipts were tampered with in the past; ICTcDA WHEREAS, the Office of the City Treasurer of Cebu currently charges Twenty Pesos (P20.00) to certify the receipts as true and correct in accordance with City Ordinance No. LXIX; WHEREAS, the Local Housing Board through Resolution No. 10-134 endorsed to the Sangguniang Panlungsod to waive the fees in validating Official Receipts of the monthly amortization payments of Socialized Housing beneficiaries; WHEREAS, the Sangguniang Panlungsod through SP Resolution No. 12-1324-2010 dated 29 October 2010 has proposed to the Office of the City Treasurer to waive the P20.00 fee in certifying Official Receipts of the monthly amortization payments of all Socialized Housing beneficiaries; WHEREAS, the Office of the City Treasurer of Cebu in a letter dated 21 March 2011 responded that it cannot grant the request of the Sangguniang Panlungsod explaining that the payment requirement of P20.00 certification of the Official Receipts is a mandate pursuant to City Ordinance No. LXIX and cannot be waived through a resolution; WHEREAS, the City's Socialized Housing beneficiaries are mostly members of the urban poor who have limited and unstable income and have requested exemption from payment of the P20.00 certification fee in view of the fact that this is an added expense on their part; WHEREAS, there is a need to amend Chapter XVIII Section 67 (i) (6) and (7) of City Tax Ordinance No. LXIX in order to grant exemption to the Socialized Housing beneficiaries from payment of the P20.00 fee in certifying the Official Receipts of their monthly amortization payments to the Cebu City Government; IcCEDA THEREFORE, the Sangguniang Panglungsod of the City of Cebu, in a regular session assembled, hereby ordains that: SECTION 1. Title . This Ordinance shall be known as "An Ordinance Further Amending Chapter XVIII Section 67 (i) (6) and (7) of City Tax Ordinance No. LXIX, as Amended, Otherwise Known as 'The Revised Omnibus Tax Ordinance of the City of Cebu.'" SECTION 2. Chapter XVIII Section 67 (i) (6) and (7) of City Tax Ordinance No. LXIX is hereby amended, to read as follows: "Section 67. Fees and Charges for Services Rendered. There shall be paid to the City Treasurer the following fees for permits that may be issued or charged for services that may be rendered by the various city departments in accordance with the rates indicated hereunder, viz. : (i) Secretary fees for the issuance of copies of official records and documents, except those copies furnished to other government offices and agencies for official business; SEIaHT 1) . . . 2) . . . 3) . . . 4) . . . 5) . . . 6) For certification of copies reproduced by a P20.00 photocopying machine, per page; Provided, all Socialized Housing beneficiaries of the Cebu City Government are exempt from payment of the fee in certifying true and correct the copies, reproduced by machine, of Official Receipts for their monthly amortization payments under the City's Socialized Housing program. 7) For certification of photocopying, per page; P20.00 Provided, all Socialized Housing beneficiaries of the Cebu City Government are exempt from payment of the fee in certifying true and correct the photocopy of Official Receipts for their monthly amortization payments under the City's Socialized Housing program. " SECTION 3. Separability Clause . The provisions of this Ordinance are hereby declared to be separable and in the event one or more of such provisions are held unconstitutional, the validity of other provisions shall not be affected thereby. SECTION 4. Repealing Clause . Any existing ordinance or any of its provision or provisions, which are inconsistent with this Ordinance, shall be deemed repealed, amended or modified accordingly.
