CAVITE PROVINCIAL ORDINANCE NO. 072-14 AN ORDINANCE AMENDING CHAPTER IV. PERMIT AND REGULATORY FEES, ARTICLE B. SECRETARY'S FEES, OF THE 2004 REVISED R EVENUE COD E OF THE PROVINCE OF CAVITE Sponsored by: Hon. Ivee Jayne A. Reyes Co-sponsored by: All SP Members WHEREAS , Section 191 of Republic Act 7160, otherwise known as the Local Government Code of 1991 provides that "Local Government Units shall have the authority to adjust the tax rates as prescribed herein not oftener than once every five (5) years, but in no case shall such adjustment exceed ten percent (10%) of the rates fixed under this Code" ; HTcADC WHEREAS , the Provincial Government of Cavite enacted its current Revenue Code in 2004, which necessitates updating and revision considering its 10 years of implementation; WHEREAS , the Revenue Code of the province has to be more responsive to the changing conditions of business and economic development, making it a more effective tool by which this province may generate incomes and revenues; WHEREFORE , there is a need to amend this ordinance to improve the financial capability as well as the fiscal administration of the Provincial Government; NOW, THEREFORE , on motion of Hon. Reyes, Chairperson of the Committee on Ways and Means, duly seconded by Hon. Gawaran and all the members present, be it enacted by the Sangguniang Panlalawigan in session duly assembled that: SECTION 1. Chapter IV . Permit and Regulatory Fees, Article B. Secretary's Fees, of the 2004 Revised Revenue Code of the Province of Cavite is hereby amended to read as follows: CAIHTE CHAPTER IV. PERMIT AND REGULATORY FEES ARTICLE B. SECRETARY'S FEES Section 4B.01. Imposition of Fees . There shall be collected the following fees from every person requesting for copies of office records and documents from various offices of the Provincial Government: 1. By the Provincial Assessor's Office: a. Processing Fee P50.00/TD b. Certified True Copy of Tax Dec. P100.00 c. Verification Fee P50.00/RPU d. Sketch Map/Tax Map P50.00/page e. Certification Fee P50.00/certification f. Reclassification Fee P2.00/sq.m. g. Annotation Fee 1/8 of 1% of the amount in consideration - Mortgage - Certificate of Sale - Bail Bond - Deed of Redemption h. Annotation Fee P50.00 - Adverse Claim - Notice of Levy - Warrant of Levy - Notice of Lis Pendens i. Cancellation Fee P50.00 (For all annotations) 2. By the Sangguniang Panlalawigan: a. Certified True Copies: - Resolutions and Ordinances P50.00/page - Stenographic transcripts P50.00/page - Minutes of the Session P50.00/page 3. By the Provincial Treasurer's Office: a. All ordinances, resolutions, executive issuances or rules and regulations or parts thereof, that are inconsistent with or contrary to the provisions of this Ordinance, are hereby deemed repealed, amended or modified accordingly. aScITE SECTION 3. Separability Clause . If, for any reason, any section or provision of this Ordinance is held unconstitutional or invalid, the other sections or provisions hereof not affected thereby, shall continue to be in force and effect. SECTION 4. Effectivity . This Ordinance shall take effect immediately after its approval and publication thereof in local newspaper of general circulation. UNANIMOUSLY APPROVED.
