CAUAYAN CITY ORDINANCE NO. 098-16 AN ORDINANCE AMENDING CITY ORDINANCE NO. 2014-025 OTHERWISE KNOWN AS THE REVISED REVENUE CODE OF THE CITY OF CAUAYAN, ISABELA PARTICULARLY CHAPTER II CITY TAXES, ARTICLE R, SECTION R.01. IMPOSITION OF RENTAL CHARGES FOR THE USE OF DON FRANCISCO L. DY MEMORIAL COLISEUM AND INCORPORATING ARTICLE S, SECTION 5.01 AND 02. FOR USE OF THE CAUAYAN CITY GUEST HOUSE FOR NON-LGU GUEST/VISITOR (Sponsored by: Hon. Bagnos A. Maximo) Be it ordained by the Sangguniang Panlungsod, City of Cauayan, Isabela that: CHAPTER I General Provisions Article C Definition of Terms, as amended Section I.C.01. When used in this Code, terms defined from (a) to (t) shall remain as originally defined, while: (u) Automation ( e.g. , Automated Verification System or AVS) a software or computer program designed to process the business permit application using the information supplied manually and/or automatically by the existing databases. (v) City Business Data Registry (CBDR) a computer-based data registry of all information relating to business and regulatory requirements of business permit. (w) Computer Network two or more computers connected to each other that perform specific tasks to process the application of new business permit. (x) Occupancy Permit a permit issued by the Building Official as represented by the City Engineering Office certifying that a building or any particular type of construction has complied with the National Building Code and Fire Code and that the same is safe for occupancy or for operation of business. (y) Unified Application Form (UAF) a form issued by the BPLO which integrates all other forms for purposes of applying new business permit. CHAPTER II City Taxes Incorporating Article R Tax on Rental Charges for the use of the Don Francisco L. Dy Memorial Coliseum as amended. Section 01. Imposition of charges. There is hereby imposed rental charges for the: (a) Use of the Don Francisco L. Dy Memorial Coliseum at one thousand pesos (P1,000.00) per day or a fraction thereof. Electricity consumed per hour 1. WITH AIRCON 1.1 Ten (10) units - P2,000.00-per hour 1.2 Sixteen (16) units - P2,500.00-per hour 1.3 Twenty (20) units - P3,000.00-per hour 2. WITH ELECTRIC FAN 2.1 Two (2) electric fans - P200.00-per hour 2.2 Four (4) electric fans - P400.00-per hour 2.3 Six (6) electric fans - P600.00-per hour 3. USE OF THE SOUND SYSTEM - P500.00-per hour Incorporating Article S. Use of the Cauayan City Guest House for non-LGU guest/visitor. Section 01. Room Rates per day. 1. Room 1 & 2 (Good for 3 person) - P800.00 per day 2. Room 3 (good for 2 person) - P500.00 per day 3. If the number of guest is more than Eight (8) the rate shall be P200/person per day. Section 2. Cut-off-time is 12:00 o'clock in the afternoon and Check-in-time is 1:00 PM. CHAPTER III Permit and Regulatory Fees Article A Mayor's Permit Fee on Business SECTION 3A.04. PAR (B). Application for Mayor's Permit 1. For a newly-started business, as amended: a. Location sketch of the new business. b. Department of Trade and Industry (DTI) Registration Certificate with approved application forms in case of single proprietorship; Securities and Exchange Commission (SEC) Registration and Articles of Incorporation and By-laws, in case of Partnership or Corporation and Cooperative Development Authority (CDA) Registration and Articles of Cooperation. c. A certificate attesting to the tax exemption, of the business is exempt. d. A certification from the Zoning Officer, for compliance of the Zoning Ordinance. e. Occupancy Permit/or Contract of Lease, if leasing. f. Barangay Clearance/Proof of filing (in case of non-issuance of Barangay Clearance within seven (7) working days from date of filing to secure a Mayor's Permit. g. One piece, one (1) x one (1) size picture of the owner or operator or in case of a Partnership or Corporation, the picture of the senior or managing partner, President or General Manager, or Chairman of the Board, for a Cooperative. h. Community Tax Certificate (CTC). i. Authority to file as the case so requires. 2. For Renewal of Existing Business Permit, as amended: a. Previous year's Mayor's Permit. b. Photocopies of the annual or quarterly tax payments. c. Photocopies of all receipts showing payment of all regulatory fees as provided for in this Code. d. Certificate of Tax Exemption from payment of local taxes or fees. e. Income Tax Return or Audited Financial Statement prescribed by the Bureau of Internal Revenue for the next preceding year. f. BIR Registration Certificate. CAIHTE g. Barangay Clearance. h. Declaration of previous year's gross sales/receipts. i. Health Certificate for all food handlers, and those required under Chapter IV Article D of this Code. j. Authority to file as the case so requires. REPEALING CLAUSE All ordinances, rules and regulations of this ordinance are hereby repealed or modified accordingly. EFFECTIVITY This ordinance shall take effect Fifteen (15) days after its posting and publication to the "BAMBOO" Official Gazette in the City of Cauayan, Isabela.
