HTcADC WHEREAS , it has come to the attention of the Sangguniang Panlalawigan of Camarines Sur that there are other non-wood forest products which are being regulated by the National Government but were not included or mentioned to be regulated in Ordinance No. 30, series of 2014, or the "Provincial Tax Code of 2014" of the Province of Camarines Sur; WHEREAS , the Sangguniang Panlalawigan therefore decides to amend certain sections of Ordinance No. 30, series of 2014, so that the policy of the Province relative to the protection of the environment will coincide and correlate with the policy of the National Government relative thereof; NOW, THEREFORE , on motion of Honorable Emmanuel H. Noble, which was duly seconded by Honorable Nellie P. Largo, Honorable Salvador A. Sear, Jr., Honorable Fabio F. Figuracion and Honorable Russel M. Baes, be it RESOLVED, AS IT IS HEREBY RESOLVED , by the Sangguniang Panlalawigan of Camarines Sur in session assembled, to enact, as it hereby enacts the following Ordinance: BE IT ORDAINED BY THE SANGGUNIANG PANLALAWIGAN IN SESSION ASSEMBLED, THAT: SECTION 1. Paragraph (t) of Section 3, Article II (Definition and Construction of Provisions) of Ordinance No. 30, series of 2014, entitled: "An Ordinance Revising the Provincial Tax Code of 1992 and 2005 of Camarines Sur Pursuant to the Provisions of Republic Act 7160, Otherwise Known as the Local Government Code of 1991" is hereby amended to read as follows: CAIHTE "Section 3. DEFINITION OF TERMS. When used in this Ordinance (a) x x x xxx xxx xxx (t) "Forest Products" shall mean timber, pulpwood, firewood, bark, treetop, resin, gum wood oil, honey, beeswax, nipa, ANAHAW , rattan or other forest growth such as BAMBOO , grass, shrub, and flowering plants, the associated water, fish game, scenic, historical, recreational and geodetic resources in the forest." xxx xxx xxx SECTION 2. Sub-paragraph (9) of Paragraph (d) of Section 30, Article VII (Annual Fix Tax), of Ordinance No. 30, series of 2014, is hereby amended to read as follows: aScITE "Section 30. x x x (d) Forest Product shall include : 1. x x x 9. Other WOOD AND NON-WOOD forest products, such as BUT NOT LIMITED TO , resin, gum, wood, oil, honey, beeswax, nipa, rattan, anahaw LEAVES AND ANAHAW POLES , nito and palma grava, bamboo [tree] POLES and its by-products, AND ALL OTHER SIMILAR WOOD AND NON-WOOD FOREST PRODUCTS ." xxx xxx xxx SECTION 3. Sub-paragraph (10) of Paragraph (f) of Section 30, Article VII (Annual Fix Tax), of Ordinance No. 30, series of 2014, is hereby amended to read as follows: "Section 30. x x x (f) Mineral Product shall include : 1. x x x (10) Other quarry minerals such as BUT NOT LIMITED TO , gold, silver, cooper, chromite, mercury, lead, zinc, manganese, iron, nickel, limestone, lime, clay, ball clay, marl, marble, talc, gypsum, phosphate rock, barite, bantonite, feldspar, gemstone, pyrite, perlite, silica, ore, sulfur, white clay, [silica] and [other similar products.] AND ALL OTHER QUARRY MINERALS NOT MENTIONED HEREIN ." DETACa xxx xxx xxx SECTION 4. Separability Clause . If, for any reason or reasons, any section or provision of this Ordinance is declared invalid or unconstitutional, other sections or provisions thereof which are not affected thereby shall continue to be in full force and effect. SECTION 5. Repealing Clause . All ordinances and executive orders inconsistent and contrary to the provisions of this Ordinance are hereby repealed or modified accordingly. SECTION 6. Effectivity . This Ordinance shall take effect fifteen (15) days after its publication and/or required period of posting. SECTION 7. Let copies of this Ordinance be furnished the Honorable Miguel Luis R.
