Garcia SB Member/PPPSK CAINTA MUNICIPAL ORDINANCE NO. 011-11 AN ORDINANCE GRANTING TAX EXEMPTION PRIVILEGES, INCENTIVES OR RELIEFS IN THE PAYMENT OF BUSINESS TAXES AND OTHER ACTIVITIES WHICH ARE ACTUALLY, DIRECTLY AND EXCLUSIVELY USED FOR EDUCATIONAL PURPOSES IN FAVOR OF ALL EDUCATIONAL INSTITUTIONS WHICH ARE DULY ACCREDITED BY THE DEPARTMENT OF EDUCATION/COMMISSION ON HIGHER EDUCATION AND REGISTERED WITH THE SECURITIES AND EXCHANGE COMMISSION AS NON-STOCK, NON-PROFIT WHEREAS, Article XIV, Section 1 of the 1987 Constitution provides that " The State shall protect and promote the right of all citizens to quality education and shall take appropriate steps to make such education accessible to all "; WHEREAS, the Municipal Government of Cainta recognizes the dedication and commitment of the educational institutions in helping the government uplift the social, economic, cultural and moral standards of educating the youth; WHEREAS, as an incentive to these educational institutions, the local government shall grant exemptions or relief in their tax payments so that they will be able to assume larger share of responsibility in educating the youth; WHEREAS, the Sangguniang Panlalawigan of Rizal passed a Resolution No. 082, s. 2011 encouraging all Sanggunian of component city and municipalities within the Province of Rizal to enact appropriate legislation granting tax exemption privileges, incentives or reliefs in the payment of business taxes and other activities which are actually, directly and exclusively used for institutions which are duly accredited with the concerned government agencies; cSEDTC NOW THEREFORE, BE IT ORDAINED AS IT IS HEREBY ORDAINED by the Sangguniang Bayan in a session duly assembled that: SECTION 1. This Ordinance shall be known as Tax Exemption Privileges, Incentives or Reliefs for All Accredited Educational Institution based in the Municipality of Cainta, Rizal. SECTION 2. Coverage. All schools and/or colleges duly accredited by the Department of Education/Commission on Higher Education, and registered with the Securities and Exchange Commission as Non-Stock, Non-Profit. SECTION 3. The Municipal Treasurer is hereby tasked to formulate guidelines, rules and regulations in giving tax exemption, incentives and reliefs for all educational institution. SECTION 4. All ordinances, rules and regulations or parts thereof, whose provisions are in conflict with, or contrary to the provisions of this Ordinance are hereby repealed, amended, or modified accordingly. SECTION 5. Separability Clause. If for any reason or reasons, any part or provision of this Ordinance shall be held to be unconstitutional or invalid, other part or provision hereof, which are not affected thereby shall continue to be in full force and effect. SECTION 6. Effectivity. This Ordinance will take effect upon its publication in a newspaper or journals of local circulation or posting of its copy at conspicuous places of the municipality. ENACTED: August 22, 2011. Let copies of this Ordinance be furnished all concerned offices for their information, guidance and implementation.
