SIXTEENTH DIVISION [CA-G.R. SP No. 52268. June 3, 1999.] PHIL. FOOD PROCESSORS AND EXPORTERS ORGANIZATION INC. (PHILFOODEX); PHILFOODEX BONDED WAREHOUSE INC. (PBWI) , petitioners , vs . COMMISSIONER OF CUSTOMS and THE DISTRICT COLLECTOR OF CUSTOMS FOR THE PORT OF BATANGAS , respondents . R E S O L U T I O N JACINTO , J p : We resolve to DISMISS outright the instant petition for review for the following reasons and under the authority of Section 7, Rule 43 of the New Rules: 1. Contrary to the provisions of Section 6(d), Rule 43 in relation to Section 2 (last paragraph), Rule 42 of the New Rules, the verification and certification against forum shopping was signed, not by petitioner, but by its counsel whose authority and designation in the corporation has not been established; 2. The petition does not contain proof that a copy thereof was served upon the Court of Tax Appeals (CTA), as required under Section 5 of Rule 43; 3. Petitioner has not appended to its petition "certified true copies of such material portions of the record referred to herein and other supporting papers", contrary to Section 6 (c) of Rule 43. SO ORDERED. Barrios and Villarama, Jr ., JJ ., concur.
