NINTH DIVISION [CA-G.R. SP CASE NO. 53695. August 6, 1999.] COMMISSIONER OF INTERNAL REVENUE , petitioner , vs . SAN MIGUEL PROPERTIES, INC. , respondents . R E S O L U T I O N DACUDAO , J p : At hand is the petitioner Commissioner of Internal Revenue's Motion to Withdraw Appeal in the above-captioned case, alleging that after a review of the Decision rendered by the Court of Tax Appeals in the same case, the herein petitioner is convinced that there is no compelling ground to disturb said Decision, finding the same to be in accordance with the facts of the case and applicable laws and jurisprudence on the matter. WHEREFORE, and as prayed for, the abovementioned motion is hereby GRANTED, and the petitioner's appeal is considered WITHDRAWN, and, accordingly, DISMISSED. LexLib SO ORDERED.
