THIRD DIVISION [C.T.A. CASE NO. 9495. January 4, 2018.] CP KELCO PHILIPPINES, INC. , petitioner , vs . COMMISSIONER OF INTERNAL REVENUE , respondent . RESOLUTION Acting on petitioner's Motion to Withdraw Petition filed on November 21, 2017, without comment from respondent despite notice per Records Verification Report dated December 15, 2017, which states that petitioner has decided to cease its operation in the Philippines, thus, it moves for the withdrawal of the Petition for Review, the same is hereby GRANTED . Accordingly, the instant case is deemed WITHDRAWN . SO ORDERED. Lovell R. Bautista, Esperanza R. Fabon-Victorino and Ma. Belen M. Ringpis-Liban, JJ. , concur.
