August 2, 2001 BUREAU OF LOCAL GOVERNMENT FINANCE OPINION 1st Indorsement Respectfully returned thru, the Provincial Assessor of Ilocos Norte, Laoag City, to the Municipal Assessor, Badoc, said province, his within letter dated April 26, 2001 requesting opinion concerning the taxability of the real properties owned by telecommunication companies particularly SMART and GLOBE Telecommunication. In this connection, attention is invited to the 1st Indorsement dated May 28, 2001 of this Bureau, copy enclosed, which ruled that "GLOBE is exempt from the payment of real property taxes on its real properties which are used in the operation of its franchise, by virtue of the `ipso facto provision (most favored treatment clause)' in Globe's franchise (R.A. No. 7229). Likewise, all real properties of SMART not used in the operation of its franchise are liable to the payment of real property taxes. aHcACI Be guided accordingly. (SGD.) BENJAMIN A.
