October 8, 2014 BUREAU OF LOCAL GOVERNMENT FINANCE OPINION Law Office of A. M. Sison, Jr. & Partners Suite 2002-A Security Bank Centre 6776 Ayala Avenue 1226 Makati City Philippines, P.O. Box 3222, MCPO Gentlemen : This refers to your letter dated March 11, 2014 addressed to the Office of the City Treasurer, Calamba City, copy furnished this Bureau, relative to your letter-protest with claim for tax credit or refund in the amount of Php107,328.28, representing excess local business tax payment made by Cosmos Bottling Corporation (CBC). EATCcI The said letter was referred to the City Treasurer of Calamba under a 1st Indorsement dated March 20, 2014 and a follow-up letter-tracer dated August 4, 2014 requesting to provide this Bureau a report of action taken on the matter. In reply, the City Treasurer of Calamba under a letter dated August 27, 2014, copy enclosed, provides that it has acted upon the request of CBC since it received the letter of protest dated March 11, 2014. The City Treasurer informed that upon submission of the documents, it has re-evaluated the gross sales for the calendar year 2013, which is the basis of year 2014 effective 2nd quarter of 2014. In view hereof, the City Treasurer found the said request of CBC meritorious and the computation of business tax for 2014 is in accordance with the gross sales of 2013 in the amount of Php226,171,628.12.
