July 21, 2014 BUREAU OF LOCAL GOVERNMENT FINANCE OPINION 1st Indorsement Respectfully referred to the ICO-City Treasurer, Muntinlupa City, for comment, the herein copy of the letter dated July 2, 2014 of Atty. Trixia Theresa B. Reyes-Pilapil in behalf of their client Petonni Oil Station (POS), addressed to the Office of the City Attorney, that City, copy furnished this Bureau. In a letter dated April 8, 2013 sent by that Office to this Bureau, it was stated that POS was offering services and operating a convenience store where refreshments and other commodities are being sold, to wit : "Accordingly to our Business Permits & Licensing Office (BPLO), Petonni Oil Station . . . was assessed for services as, contrary to its allegation, it was offering services like change oil, etc. based on inspection conducted by BPLO. It was likewise assessed as retailer for operating a convenience store where refreshments and other commodities are being sold." However, Counsel of POS allegedly claimed that the foregoing statement of that Office is a blatant lie and its reliance on the alleged inspection report conducted by the BPLO is inequitable. Counsel likewise claimed that: "The truth is that since its establishment and commencement of operation on May 16, 2013 until today, POS has a sole activity or line of business as gasoline station or retailer of petroleum products like gasoline, diesoline, kerosene, oils and lubricants only. It has never sold tires, batteries and other accessories or offered services like change oil, etc. and much more, operated a convenience store." In this connection, that Office is hereby requested to submit its comments together with a copy of the inspection report from the BPLO within five (5) days from receipt hereof. That Office is likewise directed to conduct ocular inspection to determine the nature of business of POS. (SGD.) SALVADOR M. DEL CASTILLO OIC-Executive Director
