December 15, 1997 BUREAU OF LOCAL GOVERNMENT FINANCE OPINION Mr. Oscar Ilagan Secretary Laoag City Market Vendors Association Laoag City Supermarket 2900 Laoag City S i r : This refers to Resolution No. 97-0005 of the Board of Directors of the Laoag City Market Vendors Association (LAMARVA),Inc.,recommending the appointment of Ms. Lolita K. Hernandez, President of the Association as its representative to the Market Committee. DcCIAa In this connection, please be informed that the power to appoint representative of Market Vendors Association to the local Market Committee has been transferred to the local chief executive pursuant to Department Order No. 105-88 dated October 6, 1988 of the Department, copy enclosed. It bears emphasis that Provincial Governor, City Mayor and Municipal Mayors shall strictly observe the following requirements before issuing any appointment pursuant to said Department Order: 1. a duly enacted resolution of the Market Vendors Association nominating a member as the representative to the Market Committee; and 2. favorable recommendation of the provincial/city/municipal treasurer concerned. HIaSDc Moreover, it must be pointed out that the City Mayor is clothed with the power of general supervision and control over local administrative affairs pursuant to Sec. 455 (b) (1) of the Local Government Code of 1991 which states that the city mayor, as chief executive of the city, shall "exercise general supervision and control over all programs, projects, services, and activities of the city government.
