November 17, 2000 BUREAU OF LOCAL GOVERNMENT FINANCE OPINION Dr. Dolores M. Alforte President and Chairman Puting Bato and Settlers Association, Inc. 69 Sitio Puting Bato, Inarawan Antipolo City M a d a m : This refers to your letter dated March 7, 2000 requesting assistance relative to the patent allegedly obtained by a certain Clarence Yu on the subject real property (land) claimed by your Association, located in that city. It is your allegation that the said association has a verification map entitled " Dolores Alforte et al vs. Estate Development Corporation " approved by the Director of the Bureau of Lands on January 12, 1987 per court order of Judge Patajo. In this connection, enclosed is a copy of the 2nd Indorsement dated June 29, 2000 of the City Assessor, same city, informing this Bureau that the documents submitted by the said Association as basis for their claim to allow to declare the said land in their favor and to pay real property taxes due for the subject land, are not as superior as that of the Certificate of Title held by the present owner of the subject land. The City Assessor also added that inasmuch as the subject real property is still under court litigation, his Office shall be willing to comply should the court order the cancellation of the title/tax declaration in the name of the present owner.
