May 22, 2000 BUREAU OF LOCAL GOVERNMENT FINANCE OPINION The Provincial Assessor of Rizal Pasig City S i r : This refers to your 2nd Indorsement stated March 17, 2000 relative to the letter dated February 8, 2000 of Mrs. Rachel Mabaggu of Barangay Silangan, San Mateo, that province, requesting assistance concerning the issuance of tax declaration covering a parcel of land situated in said municipality. SDAcaT In this connection, enclosed is a copy of our letter of the same date, addressed to Mrs. Rachel Mabaggu, advising her, per 2nd Indorsement of that Office, that the matter be coursed thru a court of competent authority before that Office could favorably act on her request. In this connection, enclosed is a copy of` the 2nd Indorsement dated March 17, 2000 of the Provincial Assessor of Rizal, informing this Bureau that: 1. the said Provincial Assessor's Office did not require you to submit a court order but impliedly informed that if you are in doubt of the existing Title No. 28654 and its derivatives and other records, you have the right to bring the case in court for appropriate action. 2. you failed or purposely did not mention in your letter regarding the letter dated October 12, 1999 of the Provincial Assessor, that province, copy enclosed, which explained the apparent inconsistencies regarding the status of the subject property. 3. the subject lands were already declared to different property owners as also explained in the letter dated October 12, 1999. In view of the foregoing, this Bureau concurs in the subject 2nd Indorsement of the Provincial Assessor of Rizal that the matter be coursed thru a court of competent authority before his Office could favorably act on your request.
