October 12, 2000 BUREAU OF LOCAL GOVERNMENT FINANCE OPINION Mr. Juan V. Mendoza 1313-Up Diego Street Sampaloc, Manila S i r : This refers to your letter dated June 20, 2000 requesting the issuance of tax declaration in the name of Isaac Socito Mendoza covering Lot No. 7917, with Free Patent No. 522583 over a parcel of land allegedly located at Vinisitahan, Antipolo, Virac, Catanduanes. In this connection, enclosed is a copy of the 2nd Indorsement dated September 14, 2000 of the Provincial Assessor, same province, informing this Bureau that per investigation report conducted by the Municipal Assessor of Virac, same province, the following informations were gathered: 1. That the subject property was originally declared in the name of Candido Talan since 1937; 2. That Lot No. 7917 (Pls. 622-D) was surveyed in the name of Pelagia Talan; 3. Lot No. 7917 is situated at Patas, Antipolo and not in Vinisitahan as claimed; 4. Subject property is in the actual possession of the Heirs of Candido Talan; 5. That it is being tenanted by Juan Talan, cousin of the late Feliza Talan Mendoza and succeeded by his son, Arturo and the share-harvest is being given to Belen Talan Mendoza, daughter of the late Feliza T. Mendoza. ISTDAH In view of the foregoing, this Bureau finds the stand taken by the Provincial Assessor of Catanduanes in denying your abovementioned request well taken. Very truly yours, (SGD.)
