November 28, 2001 BUREAU OF LOCAL GOVERNMENT FINANCE OPINION 2nd Indorsement Respectfully returned to the OIC-Regional Director for Local Government Finance, Department of Finance, Region IX, 3/F Ramon Tan Bldg., Campaner St., Zamboanga City. This refers to the request of the City Assessor of Pagadian City for opinion concerning the status of the taxability of the real properties owned by Zamboanga City Electric Cooperative (ZAMSURECO-I). cd2uptax05 It appears that the abovementioned request is being made in view of her contention that the Temporary Restraining Order (TRO) issued by the Supreme Court under G.R. No. 143076 dated July 25, 2000 does not include, among the electric cooperatives mentioned therein, ZAMSURECO-I. In this connection, and considering that the subject matter contained in the said TRO also concerns all other existing electric cooperatives, this Bureau is of the opinion that the ORDER to CEASE and DESIST from implementing the questioned provisions of Sections 193 and 234 of R.A. No. 7160, The Local Government Code of 1991 applies to all local government units where electric cooperatives are located. CITDES We trust that this clarifies matters. (SGD.) BENJAMIN A.
