March 30, 1999 BSP CIRCULAR NO. 194-99 CONSOLIDATED REPORT OF FOREIGN EXCHANGE ASSETS AND LIABILITIES The Monetary Board in its Resolution No. 226 dated 19 February 1999, approved for implementation the Revised FED Form 1 Report (Consolidated Report on Foreign Exchange Assets and Liabilities) including its supporting schedules. The following guidelines shall be observed in accomplishing the report which shall henceforth be called Foreign Exchange Form 1 Report (FX Form 1): 1. Effective 1 April 1999, banks shall report their foreign exchange (FX) transactions using the attached FX Form 1. Banks shall be guided by the attached Implementing Guidelines (Annex A) and Manual of Instructions (Annex B). 2. FX Form 1 shall be prepared and submitted through electronic mail as follows: Receiving Reports to Frequency Department Be Submitted Coverage of Submission Dept. of Economic Main Report daily within five (5) banking Research (DER) Schedules 2-7, days after end of 9-12 reference week Dept. of Economic Schedule 14 monthly within fifteen (15) Research (DER) banking days after end of reference month Foreign Exchange Schedules 8 & 13 daily within two (2) banking Department (FED) days after end of reference day Reports which could not be submitted through electronic mail due to communication lines problem shall be submitted in 3.5" diskette on the prescribed date of submission. 3. A minimum rank of Assistant Vice-President shall certify the veracity and accuracy of the report and schedules which shall be submitted to DER/FED following the submission of the said report/schedule. 4. Non-submission, delayed, erroneous, or incomplete reporting including submission of amended reports shall be subject to a monetary penalty of P200.00 per banking day of default until the respective report and schedules are filed with the concerned BSP department. Such penalty is equivalent to the maximum prescribed under BSP Circular No. 1389, as amended. In the implementation of the foregoing rules, delay or default shall start on the next banking day following the deadline for the submission of the reports and schedules. 5. This report will serve as a transitory report prior to the implementation of the transaction report portion of the GL/SL reporting under Circular 108 dated May 9, 1996. 7. The existing Sources and Uses of Foreign Currency Deposit (SUFCD) report required to be submitted within four (4) banking days from reference week shall cease to be submitted when FX Form 1 Report is officially implemented. 8. Effectivity of Circular No . 194 Effective April 1, 1999, banks shall report their foreign exchange transactions using Foreign Exchange (FX) Form 1 which shall replace Foreign Exchange Department (FED) Form 1 and Sources and Uses of Foreign Currency Deposit (SUFCD) Report. 2. Coverage of the Report and Submission Procedures a) The following FX Form 1 Report and Schedules covering daily transactions for a given week shall be prepared daily and submitted through electronic mail to the Department of Economic Research (DER) within five (5) banking days after end of reference week: i. Main Report Consolidated Foreign Exchange Assets and Liabilities ii. Schedule 2 Interbank Transactions iii. Schedule 3 Foreign Exchange Acquisition From Loans iv. Schedule 4 Foreign Exchange Disposition For Loans v. Schedule 5 Other Current Accounts and Transfers Acquisition/Disposition vi. Schedule 6 Investment Acquisition/Disposition vii. Schedule 7 Other Foreign Exchange Acquisition/Disposition viii. Schedule 9 Export Proceeds ix Schedule 10 Import Letters of Credit (L/Cs) Opened and Records of Goods Imported (RGI) Under DA-OA x. Schedule 11 Import Payments xi. Schedule 12 Spot and Financial Derivatives Acquisition/Disposition b) The following FX Form 1 Schedules shall be prepared daily and submitted to the Foreign Exchange Department (FED) through electronic mail within two (2) banking days from reference day: i. Schedule 8 Details of Spot and Forward FX Transactions ii Schedule 13 Foreign Exchange Position Report c) FX Form 1 Schedule 14, Consolidated Foreign Exchange Assets and Liabilities (In Original Currency), as of end of reference month shall be submitted to the DER within fifteen (15) banking days after end of reference month. Schedule 14 is required to be reconciled with the Consolidated Statement of Condition (DCB I/II Form 2A.1/2A.2). A reconciliation statement, in hard copy, shall be submitted to the DER on the next banking day following the deadline of submission of Schedule 14. 3. Certification of a Designated Officer of the Reporting Bank To ensure the accuracy of the report, banks shall designate an Officer of the bank with a minimum rank of Assistant Vice-President who shall certify the veracity and accuracy of the reports and schedules using the attached format. (DER-Schedule A; FED-Schedule B) For the Main Report, Schedules 2-7, 9-12, a written certification, pertaining to daily reports, shall be submitted to the DER not later than the third banking day after the deadline of submission of the reports. For Schedule 14, a written certification shall be submitted to the DER on the next banking day following the deadline of submission of the report. For FX Form 1 Schedules 8 and 13, a separate written certification covering the daily report shall be submitted weekly to the FED not later than the third banking day after the end of each week. The list of names and specimen signatures of designated officers who will certify the accuracy and veracity of the reports shall be submitted separately to the DER and FED on or before 7 April 1999. 4. Monetary Penalty Monetary penalties shall be imposed on the following except those provided under "Subsec. x 162.2 a (2)" of the Manual of Regulations for Banks: A. Erroneous and/or incomplete reporting on a per schedule/report basis of P200.00 per banking day; The report is considered erroneous if there are misclassification of accounts; erroneous entries or those resulting in changes or revisions in the amounts/totals of the Main Report and/or each schedule. The report is considered incomplete if it fails to provide the required information in the respective columns and rows of the report and schedules. B. Non submission of amended reports Banks shall be notified of incomplete/erroneous reports after validation and shall be required to submit amended reports within the following banking day from receipt of written notification. Non compliance shall subject the erring bank(s) to monetary penalty of P200.00 per banking day of default until the amended report is submitted. C. Chronic delayed reporting including submission of amended reports shall be subject to an additional monetary penalty of P2,000.00 per banking day until the respective report and schedules are correctly submitted. See Attachment for sample computation. Non-submission and/or delay in the submission of reconciliation statement, as prescribed in 2 c) above, shall be subject to monetary penalty of P200.00 per banking day of delay until the statement is submitted. E. All of the above-cited monetary penalties shall be waived for the month of April, 1999. 5. Manner of payment or collection of fines Manner of payment or collection of monetary penalties shall be guided by Section 91 (2) of Circular No. 1389 dated 13 April 1993, as amended. 6. Reporting Instructions for FX Transactions For purposes of reporting transactions under Book Code 2 FCDU, name of counterparty depositor may be filled up with the consent or waiver from the depositor. If without the consent from the depositor indicate " corporate " for transaction of an enterprise and " individual " for transaction of an individual. LLpr 7. Retention of Supporting Documents For purposes of audit trail and validation by the concerned BSP Departments, banks are required to retain the written application to purchase foreign exchange filled out by clients, including the supporting documents evidencing the required payments to be made within a period of six (6) months from the date of transaction. LLjur I. PURPOSES FX Form 1 Report serves the following purposes: To establish on a current basis the international payment position of commercial banks. To serve as a database for the compilation of the balance of payments account of the country and, by extension, the national income accounts of the Philippines. To provide a basis for prudential supervision and monitoring compliance with foreign exchange regulations by the BSP. II. CONCEPT A. The data submitted under FX Form 1 will provide a systematic record of: 1. Transactions under the following mode: a. Actual receipts and disbursements of foreign exchange between residents and non-residents; b. Actual purchases and sales of foreign currency that are eligible to form part of the country's international reserve; c. Transfer of foreign assets to and from residents; 2. Foreign exchange transactions between residents and non-residents with the banks acting as intermediaries that will give rise to actual receipts and disbursements in the near future; and 3. Foreign exchange transactions undertaken by the bank for its own accounts resulting in contra-entries in the banks' monetary foreign exchange assets and liabilities. B. Definition of Resident and Non-Resident 1. Resident is an economic unit which has a center of economic interest in a given country. An entity has a center of economic interest in a given country when there exists some location (dwelling) place of production, or other premises within the economic territory on, in or from which the unit engaged and intend to continue engaging (either indefinitely or over a finite but lengthy period of time) in economic activities and transactions on a significant scale. Resident comprises the following types of economic units: a. An individual citizen of the Philippines residing therein; b. An individual who is not a citizen of the Philippines but is permanently residing therein; c. A corporation or other juridical person organized under the laws of the Philippines; d. A branch, subsidiary, affiliate, extension office or any other unit of corporations or juridical persons organized under the laws of any foreign country operating in the Philippines; e. The Philippine Government, its agencies and instrumentalities; and f. Non-profit institutions. 2. Non-resident an individual, corporation or other judicial person not included in the above definition of resident. It refers to an individual, enterprise or other organization ordinarily domiciled in a country other than the Philippines. Similarly, branches and subsidiaries of Philippine companies operating abroad are regarded as non-residents. III. DEFINITION OF ACCOUNTS Monetary Foreign Assets actual foreign currency denominated claims of the Philippine offices of banks from non-residents except Due from Other Banks-Local Banks FX Clearing; Non-monetary Foreign Assets actual foreign currency denominated claims of the Philippine offices of banks from residents, except Due from HO/Branches/Agencies Abroad-Assigned Capital-Regular; Monetary Foreign Liabilities actual foreign currency denominated obligations of Philippine offices of banks to non-residents except Due to Local Banks-FX Clearing; Non-monetary Foreign Liabilities actual foreign currency denominated obligations of Philippine offices of banks to residents, except Due to HO/Branches/Agencies Abroad-Assigned Capital-Regular. For the definition of the general ledger accounts under the main report (Consolidated Foreign Exchange Assets and Liabilities) refer to Manual of Accounts under Circular 108 dated May 09, 1996. IV. REPORTING PROCEDURES Consolidated Foreign Exchange Assets and Liabilities (Main Report Schedule 00 ) Report the daily balances of foreign exchange assets and liabilities for each unit under the columns for Regular and FCDU. Classify both assets and liabilities into monetary and non-monetary accounts. Net FX Position for International Reserves Purposes under item C (total monetary assets minus total monetary liabilities) should equal the Net FX Position, End of Day in Schedule 1. Daily Summary of Foreign Exchange Acquisitions/Dispositions (Schedule 1) Report the NET FX POSITION FOR INTERNATIONAL RESERVES PURPOSES PREVIOUS DAY . (Item C of Main Report Consolidated FX Assets and Liabilities) ADD : FX ACQUISITIONS actual foreign exchange receipts of residents from non-residents coursed through the local commercial banks, actual purchases of foreign exchange for pesos and actual cash transfers to residents from non-residents. A. Export Proceeds foreign exchange receipts arising from sales and shipments of goods to the other countries, including sale of gold to international market. B. Financial Derivatives Acquisition foreign exchange receipts arising from settlement of financial derivatives transactions. LESS : FX DISPOSITIONS foreign exchange payments of residents to non-residents coursed through the local commercial banks, actual sales of foreign exchange for pesos and actual cash transfers to non-residents from residents. A. Import Payments foreign exchange payments of goods purchased and received from other countries. B. FX Disposition for Loans repayments of foreign loans granted to residents as well as loans disbursed by residents to non-residents, excluding banks' own transactions, subject to existing regulations on foreign loans. 2. Direct Investments foreign exchange dispositions involving withdrawal of capital investments and interbranch placements of non-residents as well as residents' direct investment abroad. 3. Portfolio Investments foreign exchange dispositions involving withdrawal of non-residents' investments in stocks, securities and deposit placements as well as residents' portfolio investment abroad. 4. Other Current Accounts and Transfers Disposition foreign exchange payments for services rendered by non-residents, gifts/donations disbursed by residents and migrants' transfers. 5. Other FX Disposition other foreign exchange dispositions not covered in the above accounts. 6. Roll-over of principal including interest should not be reported. Enter actual amount of foreign exchange received. 015/026 Sale of Government Bonds, Bills and Notes. Enter actual amount of FX received. /027 FX Clearing. Enter transactions with Citibank as the franchise holder of the Philippine Domestic Dollar Transfer System (PDDTS). Report under this code interest earned from PDDTS FX Clearing Account Citibank and availment of overdraft facility from Citibank. The PDDTS franchise holder should report an acquisition under this transaction code on the settlement date of the overdraft facility. /028 Sale of Private Bonds, Bills and Notes. Enter actual amount of foreign exchange received. B. Disposition : To BSP/To Local Banks 031/041 Spot Sales and Deliveries on Swap, Forward and Other Financial Derivatives Transactions. This transaction code is for the use of the franchise holder of the Philippine Domestic Dollar Transfer System (PDDTS) only. Enter interest paid to the participating banks as well as their availment of the overdraft facility. /048 Purchase of Private Bonds, Bills and Notes. Enter acquisition cost of private-issued bonds, bills and notes bought. 036/ Surrender of Gold Proceeds. Proceeds from buying gold sold to BSP. BANK CODE Enter counterparty bank code. FX Acquisition from Loans (Schedule 3) LOAN TRANSACTION CODE Classify according to the following transaction codes: 010 Foreign Loan Availment of Residents proceeds of resident's Loan from foreign creditors, excluding banks own transaction. 020 Export advances foreign exchange proceeds from advance payment on exports. 030 Repayment of loans granted to non-residents payment of non-resident's loan granted by residents, subject to existing regulations on foreign loans. In US$ Equivalent Enter the US$ equivalent of the amount of availment in original currency on transaction date. FX Disposition for Loans (Schedule 4) LOAN TRANSACTION CODE Classify according to the following transaction codes: 010 Repayment of foreign loans by residents payment of residents' loan to foreign creditors, excluding bank's own transactions. 020 Repayment of Export advances a non-add item under FX disposition representing value of export shipment applied to payment of export advances. 030 Foreign Loans Granted by residents payment of loan granted by residents to foreign creditors, subject to existing regulations on foreign loans. BANK REF . NO . /BSP DAN/MEDD REG . NO . Enter the appropriate reference number assigned to these accounts upon availment of loan.
