An Ordinance Granting a Tax Discount to Owners of Real Properties for Tax Year 2014 with Prompt Payments Made on or Before March 31, 2014

January 29, 2014 Excerpt from the Minutes of the Regular Session of the 4th Sangguniang Panlungsod of the City of Bogo Held at the Session Hall on January 29, 2014. WHEREAS , Section 246 of RA 7160 provides that "the real property tax for any year shall accrue on the first day of January and from that date it shall constitute a lien on the property which shall be superior to any other lien, mortgage, or encumbrance of any kind whatsoever, and shall be extinguished only upon the payment of the delinquent tax"; aDSIHc WHEREAS ,further, Section 255 thereof, provides that: "In case of failure to pay the basic real property tax upon expiration of installment periods, or when due, as the case may be shall subject the taxpayer to the payment of interest at the rate of two percent (2%) per month on the unpaid amount or a fraction thereof, until the delinquent tax shall have been fully paid: Provided, however ,That in no case shall the total interest on the unpaid tax or portion thereof exceed thirty-six (36) months"; WHEREAS ,Section 276 so provides that: "In case of a ...calamity, the sanggunian concerned, by ordinance passed prior to the 1st day of January of any year and upon recommendation of the Local Disaster Coordinating Council, may condone or reduce, wholly or partially, the taxes and interest thereon for the succeeding year or years in the city affected by the calamity; WHEREAS ,the Sangguniang Panlungsod deems it fit and proper to grant discounts to owners of real properties with prompt payments to extended period for tax year 2014 in light of the material damage brought about by Super Typhoon Yolanda on November 8, 2013; NOW THEREFORE ,on motion of Hon. Rhett E. Minguez seconded by Hon. Santiago M. Oliamot, be it; ATICcS RESOLVED ,to enact the following: BOGO CITY ORDINANCE NO. 002-14 AN ORDINANCE GRANTING A TAX DISCOUNT TO OWNERS OF REAL PROPERTIES FOR TAX YEAR 2014 WITH PROMPT PAYMENTS MADE ON OR BEFORE MARCH 31, 2014 Authored by Hon. Rhett E. Minguez Chair, Committee on Laws and Ordinances Be it ordained by the Sangguniang Panlungsod of the City of Bogo in session assembled that: SECTION 1. Declaration of Policy . The City of Bogo is a government responsive to the needs of the people, that following a calamity all affected sectors of the local economic picture need time to rehabilitate and recover. To provide relief to real property owners a discount shall be given up to an extended period. ETHIDa SECTION 2. Coverage . This ordinance covers all real properties within the jurisdiction of the City of Bogo with tax due for year 2014. SECTION 3. Discount . A discount of twenty percent (20%) shall be granted to real property owners whose payments are made in full on or before March 31, 2014. SECTION 4. Offsetting . Payments made by real property owners who did not avail of the discount herein provided shall be offsetted in the tax due of the same property in the year. SECTION 5. Effectivity .
