DEL CASTILLO OIC-Executive Director ATTACHMENT July 26, 2013 COMELEC RESOLUTION NO. 9749 IN THE MATTER OF ADOPTING RESOLUTIONS PROMULGATED FOR THE 2010 BARANGAY AND SK ELECTIONS AND 2013 NATIONAL AND LOCAL ELECTIONS FOR THE CONDUCT OF THE 28 OCTOBER 2013 BARANGAY AND SK ELECTIONS WHEREAS, under Republic Act No. 10352 or the General Appropriations Act for the Fiscal Year 2013, only One Billion, One Hundred Seventy-Five Million and Ninety-Eight Thousand Pesos (PHP1,175,098,000.00) was allotted and set aside by Congress for the conduct of the 2013 Barangay & Sangguniang Kabataan Elections; WHEREAS, the foregoing amount is insufficient to defray all the necessary and reasonable expenses to successfully hold and manage the 2013 Barangay & Sangguniang Kabataan Elections and to ensure that the said elections are honest, orderly, peaceful, and credible; WHEREAS, the Commission, in keeping with the budgetary constraints, is desirous of saving on costs for the publication of numerous promulgated Resolutions applicable only to the 2013 Barangay & Sangguniang Kabataan Elections; and WHEREAS, previously promulgated Resolutions for the 2010 Barangay & Sangguniang Kabataan Elections and the 2013 National & Local Elections may be adopted for reimplementation for purposes of the conduct of the 2013 Barangay & Sangguniang Kabataan Elections, subject to certain modifications. NOW THEREFORE, after due deliberation, the Commission En Banc , by virtue of the powers vested in it by the Constitution, the Omnibus Election Code, the Local Government Code, and Republic Act Nos. 6653, 6679, 8524, 9164, and 9340, hereby RESOLVES to ADOPT the following Resolutions , as specifically modified accordingly, for the conduct of the 2013 Barangay & Sangguniang Kabataan Elections: DACTSa Resolution Title Specific Modifications No. 9672 Implementing Rules on the [In lieu of Resolution No. 9043] Filing of Complaints for Violations of Resolution No. No specific modifications. 9615 or "Rules and Regulations Implementing Republic Act No. 9006, Otherwise Known as the 'Fair Election Act'", and Delegating to the Clerk of the Commission the Reception of Evidence for said Violations in connection with the 13 May 2013 National and Local Elections 9666 A Resolution Regulating the No specific modifications. The Chairman of the Commission on Elections is hereby authorized to approve/disapprove the recommendations of the Law Department on requests for exemption from the coverage of the ban involved in this resolution. Such action by the Chairman shall take effect immediately, subject however to the confirmation by the Commission En Banc." 9615 Rules and Regulations [In lieu of Resolution No. 9043] Implementing Republic Act No. 9006, otherwise known as the Cf. Pleadings, motions, and similar papers failing to comply shall not be accepted. For purposes of the 2013 Barangay & Sangguniang Kabataan Elections, the provisions of COMELEC Resolution No. 9621 setting the guidelines for submission via e-mail shall not apply." 9476 Rules and Regulations [In lieu of Resolution No. 9043] Governing Campaign Finance Cf. Resolution Nos. 9672, 9616 and Disclosure in connection and 9615, supra. with the 13 May 2013 National and Local Elections and N.B. As amended by Resolution Subsequent Elections Thereafter No. 9558, and as supplemented by Resolution No. 9616. 1 Section 1, Rule 4 is amended to read as: "The aggregate amount that a candidate may spend for an election campaign for purposes of the 2013 Barangay & Sangguniang Kabataan Elections shall be FIVE PESOS (PHP5.00) for every voter currently registered in the constituency where the candidate filed his certificate of candidacy." 2 Section 1, Rule 8 is amended to read as: "Not later than five (5) days after the conduct of the elections, candidates shall be reminded and advised in writing, by personal delivery or registered mail, to comply with the obligation to file their statements of contributions and expenditures in connection with the elections." 3 Section 5, Rule 8 is removed or deleted. 9371 Rules and Regulations on [In lieu of Resolution Nos. Detainee Registration and 9012 and 9070] Voting in connection with the May 13, 2013 National and 1 Delete Section 3. Local Elections and Subsequent Elections Thereafter 2 Any reference to "Resolution No. 9149" is amended to read as: "Resolution No. 9716". 3 The date in Section 1 (a), Rule 3 is amended to read as: "first Monday of August of the election year". 4 The date in the first paragraph of Section 1 (b), Rule 3 is amended to read as: "last working day of July of the election year". 5 The date in the second paragraph of Section 1 (b), Rule 3 is amended to read as: "on or before the last Monday of August of the election year". 6 Section 1, Rule 6 is amended to read as: "Voting for all qualified detainee voters shall take place on the same date as the elections to be conducted. For jails provided with special polling places, voting shall start at 7 o'clock AM and must be finished by 12 o'clock NN to have a sufficient time to bring the filled-up ballots to detainees' respective precincts before they close at 3 o'clock PM on election day. In case all the expected detainee voters have voted before 12 o'clock NN, the SBET may close the voting in the special polling places and dispose of all election paraphernalia. In the event that voting cannot be finished by 12 o'clock NN, the SBET shall notify the BETs of the regular polling precincts of the affected detainees of such fact to forestall the possibility that detainees' filled-up ballots will not be counted, and thereafter continue voting. However, no voting shall take place beyond 1 o'clock PM. For detainees voting in the regular precincts, voting hours will start at 7 o'clock AM and will end at 3 o'clock PM." 9043 Rules and Regulations Cf. Resolution Nos. 9476 and Governing Election Campaign, 9615, supra. Propaganda, Contributions and Expenditures in connection 1 Sections 1-20 are deemed with the October 25, 2010 superseded by Resolution Barangay and Sangguniang Kabataan Nos. 9476 and 9615 as Elections adopted for the 2013 Barangay & Sangguniang Kabataan Elections. 2 Sections 21-26 are retained and adopted for reimplementation for the 2013 Barangay & Sangguniang Kabataan Elections. 9038 Prohibition on the Appointment No specific modifications. of Barangay Officials as Members of the Board of Election Tellers or as Watcher of Any Socio-Civic, Religious, Professional Organization in connection with the October 25, 2010 Barangay and Sangguniang Kabataan Elections In the reimplementation of the foregoing Resolutions , the following modifications are made generally applicable: 1. Any and all references to the "October 25, 2010 Barangay and Sangguniang Kabataan Elections", the "May 13, 2013 National, Local and ARMM Elections", or their conceptual equivalents, are to be read and understood as the "28 October 2013 Barangay and Sangguniang Kabataan Elections". 2. Any and all references to "election period" are to be read and understood as the time period from "28 September 2013 to 12 November 2013". 3. Any and all references to "campaign period" are to be read and understood as the time period from "18 October 2013 to 26 October 2013". 4. Any and all references to "election day" are to be read and understood as referring to "28 October 2013". 5. Any and all references to "COMELEC Resolution No. 9019" or "COMELEC Resolution No. 9385" are to be read and understood as referring to "COMELEC Resolution No. 9715" entitled "Calendar of Activities and Periods of Certain Prohibited Acts in connection with the October 28, 2013 Synchronized Barangay and Sangguniang Kabataan (SK) Elections", promulgated on 18 June 2013. TEAICc 6. Any and all references to the "Board of Election Inspectors", "BEI", "Special Board of Election Inspectors", or "SBEI" are to be read and understood as referring to the "Board of Election Tellers", "BET", "Special Board of Election Tellers", or "SBET", respectively. 7. Any and all references to a "political party", "political parties", "political groups", "parties who manifested their intent to participate in the elections", or simply "party", when referring to the group or association of persons as defined under Section 4 (g) of Resolution No. 9476 or Section 1 (3) of Resolution No. 9615, including "treasurer of a party", are to be deleted or removed. 8. Any and all references to "national positions" are to be deleted or removed. The Commission FURTHER RESOLVES to DIRECT the Information Technology Department, this Commission, to REPOST copies of all the aforementioned Resolutions at the COMELEC Website (www.comelec.gov.ph). Let the Project Director of the Project Management Office for the 2013 Barangay & Sangguniang Kabataan Elections and all Departments mentioned in the foregoing Resolutions implement this Resolution. RESOLVED further, that in so far as Resolution No. 9561-A (Resolution on Gun Ban) is concerned, gun ban exemptions issued in connection with the May 13, 2013 National and Local Elections shall be recognized as valid for purposes of the October 28, 2013 Synchronized Barangay and Sangguniang Kabataan (SK) Elections. However, approved applications for employment/availment/engagement of security personnel/agencies during the May 13, 2013 National and Local Elections shall be subject to renewal for purposes of the October 28, 2013 Synchronized Barangay and Sangguniang Kabataan (SK) Elections. This Resolution shall take effect on the seventh (7th) day after its publication in two (2) daily newspapers of general circulation in the Philippines. The Election and Information Department (EID) shall cause the publication of this Resolution in two (2) daily newspapers of general circulation in the Philippines.
