October 10, 2012 BLGF MEMORANDUM CIRCULAR NO. 074-12 TO : All BLGF Regional Directors, Assessors, Assistant Assessors, and Appraisers in the Local Government Service, and Officers and Members of Organizations of Local Government Assessors and Appraisers SUBJECT : Enjoining All Eligible Assessors, Assistant Assessors and Government Appraisers to Participate in the First National Elections of the Philippine Institute of Real Estate Service Practitioners In support of the Government's professionalization agenda for real estate service practitioners, particularly the assessors, assistant assessors and appraisers in the local government service, pursuant to Republic Act No. 9646, otherwise known as the Real Estate Service Act (RESA), and in line with the communication of the Philippine Institute of Real Estate Service Practitioners (PhilRES), Inc., the accredited and integrated professional organization (AIPO) of real estate service professionals, pursuant to Sec. 34 of RESA, through its president, Mr. Gener R. Sison, Assessor of Mandaluyong City, the following are hereby informed: AcSHCD 1. The Professional Regulation Commission (PRC) issued Resolution No. 19, s. 2011 on October 21, 2011 recognizing the PhilRES, Inc. as the official AIPO of real estate service professionals, pursuant to RESA. 2. The PhilRES has adopted and published in Manila Bulletin on 1 September 2012 its New By Laws, Official Membership Guidelines, Official Implementing Rules on Chapter Formation Official Application Forms for Individual Membership, Official Personal Date Sheet Forms, Chapter Formation Rules and Procedures, as well as Election Rules, Procedures and Forms, as herein enclosed, which may be viewed and downloaded from PhilRES's official Facebook page (www.facebook.com/philres2011), as mirrored in the websites of the Philippine Association of Local Treasurers and Assessors, Inc. (www.phaltra.org), this Bureau (www.blgf.gov.ph), and the LAMP2 Component 4 project (www.valuationreforms.org.ph). 3. All real estate service practitioners, including assessors, assistant assessors and government appraisers, are now being notified and mobilized for the first National Elections scheduled on November 18, 2012. 4. Pursuant to Section 139 of the New By Laws adopted by PhilRES, the eligible members who can participate in the said elections are the following: a. Real estate service practitioners who have already signed in the Roster of Registered Professionals with the PRC; b. Those who have already been issued their respective PRC IDs and Certificates of Registration, prior to the holding of the First Regular General Membership National Convention and Nominations; TCaADS c. Those persons whose names appear in the list/s of approved applicants for licensing without examinations published and/or officially announced by the PRC. d. Those who have already signed the Roster of Registered Professionals with the PRC, but have not been issued their respective PRC IDs and Certificates of Registration; and e. Those examinees whose names appear in the list/s of examinees who successfully passed the licensure examinations for real estate service practitioners published and/or officially announced by the PRC, including those who have yet to receive their respective PRC IDs and Certificates of Registration. In view of the foregoing and in line with the thrust of this Bureau to further the professionalization and development of real estate service professionals, all concerned, specifically the eligible assessors, assistant assessors and government appraisers, are hereby enjoined to participate in the said First National Elections of PhilRES. Enclosed are the important forms, documents, and dates, as well as the detailed procedures in view of the upcoming elections. Only members paid and with document submitted as of October 05 are eligible to a. To be nominated b. To nominate c. To vote should there be a contest between 2 or more nominees in any position 2. These members shall be submitted by Chapter to National Directorate by October 08. 3. These members shall be confirmed by National Directorate by October 12. 4. These members shall be allowed to participate in any selected schedule of Chapter Nomination anytime between October 13-18. 5. Chapter shall constitute a Chapter COMELEC to facilitate the Chapter Nomination Process. 6. Chapter COMELEC shall submit to National COMELEC the results of the Chapter Nomination. Scheduling Protocol 7. Chapter is required to submit by e-mail: [emailprotected] the following on or before October 10: 1.1 Five (5) members as Chapter COMELEC who will facilitate the nomination. (See COMELEC Election Form #1: "PhilRES Chapter COMELEC Members") 1.2 Submit Letter of Intent (LOI) for Chapter Nomination specifying the nomination date, venue and process. (See COMELEC Election Form #2: "PhilRES Chapter Nomination Advisory") 8. Chapter to receive from National Board the "Confirmed List of Chapter's Official Roster of Voters and Eligible Candidates for the Chapter Nomination" on October 12. List to be given to Chapter COMELEC Chair and Interim President. The list shall be the only basis for participation of members in Chapter Nomination. Nomination Imperatives 9. Chapter COMELEC shall prepare the nomination process by "secret ballot". 10. Chapter COMELEC shall prepare a system for Election Protest with appeal mechanism to National Directorate who will resolve the issue in summary proceeding not later than 48 hours. Nomination Procedures 11. Chapter COMELEC to conduct the chapter nomination as per submitted LOI. 12. Nomination to all positions is open to any member except for Vice Presidents of Consultants, Government Assessors, Appraisers, Government Appraiser and Brokers which requires the corresponding license eligibility. 13. Chapter COMELEC to ask for nomination and conduct canvassing according to the following hierarchy of national positions: ATHCDa i. Chairman of the Board ii. Vice Chairman iii. President iv. Executive Vice President v. Secretary General vi. VP for Consultants vii. VP for Gov't Assessors viii. VP for Gov't Appraisers ix. VP for (Private) Appraisers x. VP for Brokers xi. VP for Treasury xii. VP for Membership xiii. VP for Chapter Dev't and Chapter Affairs xiv. VP for Administration xv. VP for Internal Audit xvi. Regional Vice President 14. In case of position with 2 or more nominees, Chapter COMELEC shall determine the official candidate through an election process agreed upon by the chapter members. 15. Nomination to any position is optional with Chapter reserving its right to send or not to send a corresponding candidate for the National Election. Member's Right of Suffrage 16. Chapter member reserves the right to participate or not in the Chapter Nomination. 17. Any member may choose to vote and/or be nominated during the Chapter Nomination. 18. Any member may be nominated to any or all national positions subject to corresponding license eligibilities. Submission of Chapter Nominees 19. The Chapter COMELEC Chair and the Interim President are required to submit the official result of chapter nomination to National COMELEC on 18 October 2012 not later than five o'clock in the afternoon by e-mail at [emailprotected].
