September 30, 2008 BLGF MEMORANDUM CIRCULAR NO. 017-08 TO : All BLGF Officials and Employees, Regional Directors for Local Government Finance, District Treasurers of Metropolitan Manila; Provincial, City and Municipal Treasurers and Others Concerned SUBJECT : Small and Medium Enterprise Development (SMED) Council Resolution No. 1, Series of 2008, entitled "Requesting the Department of Finance (DOF) to Enjoin the Treasurers to Submit Quarterly Reports on the Implementation of the Republic Act No. 9178, Otherwise Known as the Barangay Micro Business Enterprises (BMBEs) Act of 2008" In order to enhance awareness and support, to the provisions of Republic Act No. 9178, otherwise known as the "Barangay Micro Business Enterprises (BMBE) Act of 2002", the SMED Council requests the DOF to enjoin its City and Municipal Treasurers to submit quarterly reports on their implementation of the BMBE Act to the Provincial SMED Councils in their respective areas. This is to closely monitor LGUs' compliance with the mandate and objective of R.A. 9178 and its Implementing Rules and Regulations (IRR). Attached is a copy of the SMED Council Resolution No. 1 and the letter of the Head, SMED Council Secretariat Director, BSMED, for the information and guidance of all concerned. The Regional Directors of this Bureau are hereby instructed to disseminate the contents of this Circular to all Provincial, City and Municipal Treasurers within their respective jurisdiction, likewise enjoining them to observe and comply with the provisions thereon. This is to closely monitor the compliance of the Local Government Units (LGUs) with the mandate and objectives of the Act and its Implementing Rules and Regulations. LEAO Head, SMED Council Secretariat Director, BSMED SMED Council Resolution No. 1 Series of 2008 "Requesting the DOF to enjoin the Treasurers to submit quarterly reports on the implementation of the BMBEs Act of 2002 to the Provincial SMED Councils in their respective areas" WHEREAS, Republic Act 6977, as amended by R.A. 8289, otherwise known as the "Magna Carta for Small Enterprises", mandates the SMED Council to promulgate implementing guidelines, programs, and operating principles as may be deemed proper and necessary to spur the growth and development of SMEs throughout the country; TcDAHS WHEREAS, in 1997, Provincial SMED Councils were created nationwide which are mandated to be primarily responsible for the promotion, growth and development of SMEs in the provinces; WHEREAS, R.A. 9178, otherwise known as the "Barangay Micro Business Enterprises (BMBEs) Act of 2002", was enacted to hasten the country's economic development by encouraging the formation and growth of BMBEs through the rationalization of bureaucratic restrictions and granting of incentives and benefits to generate much-needed employment and to alleviate poverty; WHEREAS, the Department of Finance (DOF) has issued Department Order No. 17-04: Guidelines to Implement the Registration of BMBEs and the Availment of Tax Incentives under the BMBEs Act; WHEREAS, Rule 6 Sec. 2 of the said Department Order provides that the Treasurers and BIR shall render an annual report to the Secretary of Finance, copy furnished the Secretary of Trade and Industry, on their implementation of the Act; WHEREAS, in the 114th SMED Council meeting held on 07 February 2008, the body agreed to request the DOF to enjoin the Treasurers to submit quarterly reports on their implementation of the BMBEs Act to the Provincial SMED Councils (c/o the DTI Provincial Offices) in their respective areas so as to closely monitor LGUs' compliance with the mandate and objective of R.A. 9178 and its Implementing Rules and Regulations; NOW, THEREFORE, be it resolved, as it is hereby resolved, that the SMED Council requests the DOF to enjoin the Treasurers to submit quarterly reports on their implementation of the BMBEs Act to the Provincial SMED Councils (c/o the DTI Provincial Offices) in their respective areas.
