Revised Rules on the Effects of Pendency of a Criminal or Administrative Case in the Conferment of CES Eligibility

July 8, 2008 BLGF MEMORANDUM CIRCULAR NO. 011-08 TO : All BLGF Officials and Employees, Regional Directors for Local Government Finance, District Treasurers of Metropolitan Manila; Provincial, City and Municipal Treasurers and Others Concerned SUBJECT : Revised Rules on the Effects of Pendency of a Criminal or Administrative Case in the Conferment of CES Eligibility For the proper implementation of the provisions of Article II, Section 11, of the Philippine Constitution, below is the full text of said provision for the information, guidance and compliance of all concerned, to wit: "Section 11. The State values the dignity of every human person and guarantees full respect for human rights. Philippine authorities, therefore, have the responsibility of protecting and promoting the right of every person to liberty and due process, particularly the right to be presumed innocent until the contrary is proved." Relative thereto, the Career Executive Service Board (CESB) adopted the "Revised Rules on the Effects of Pendency of a Criminal or Administrative Case in the Conferment of CES Eligibility" through CESB Resolution No. 716 dated February 12, 2008. For this purpose, attached is a copy of the CESB Resolution No. 716 published in the Official Gazette on April 7, 2008 stating among others that the pendency of a criminal/administrative case shall not restrict/bar the conferment of CES eligibility to a successful applicant, unless there is a law to the contrary. caIETS The Regional Directors of this Bureau are hereby instructed to disseminate the contents of this Circular to all Provincial, City and Municipal Treasurers within their respective jurisdiction, likewise enjoining them to observe and comply with the provisions thereon. In line with this constitutional guarantee of presumption of innocence, the Career Executive Service Board through CESB ResolutionNo.716 dated February 12, 2008 adopted the "Revised Ruleson the Effects ofPendency of a Criminal or Administrative Case in the Conferment of CES Eligibility". Pursuant thereto, the pendency of a criminal/administrative case shall not constitute a bar to the conferment of CES eligibility to a successful applicant, unless there is a law to the contrary.
