BISLIG CITY ORDINANCE NO. 023-19 TAX AMNESTY ON DELINQUENT REAL PROPERTY TAX ORDINANCE OF THE CITY OF BISLIG, SURIGAO DEL SUR WITH RESPECT TO PENALTIES ON THEIR REAL PROPERTY TAX FOR PRIOR YEARS' PERIOD UPON PAYMENT THEREOF FROM JANUARY TO JUNE 2020 Authored by: Hon. Cacayan WHEREAS , there has been a substantial decrease in prices of copra, rice and abaca over the past years; HTcADC WHEREAS , the City also declared a State of Calamity through SP Resolution No. 2019-480 due to scarcity of potable water; WHEREAS , Sec. 276, Local Government Code of 1991 allows condonation of Real Property Taxes in cases of substantial decrease in prices of crops and any other calamities; WHEREAS , the City Disaster Risk Reduction Management Council passed DRRMC Resolution No. 2019-14 recommending the passage of the instant Ordinance for condonation; WHEREAS , in view of the foregoing, this Sanggunian is sympathetic to the plight of its constituents who are adversely affected by the calamity; WHEREAS , one of the immediate assistance the City can give to its inhabitants is the grant of a tax amnesty; BE IT ORDAINED by the Sangguniang Panlungsod of the City of Bislig, in session duly assembled: SECTION 1. Relief . A one hundred percent (100%) relief amnesty on interest and penalties for delinquent real property taxes inclusive from prior years up to the year 2019 is hereby granted to Real Property Taxpayers in Bislig City. SECTION 2. Prohibition . No public auction of Delinquent Real Properties shall be held during the period of tax relief or amnesty. SECTION 3. Conditions . One hundred percent (100%) of the accumulated interests and penalties of the Delinquent Real Property Taxes shall be condoned; provided, that the taxes covering the delinquent period shall be fully paid including the current year within the prescribed period of Relief or Amnesty as embodied under this Ordinance. SECTION 4. Exclusion . This Ordinance shall not apply to any of the following: a) Delinquent Real Properties which have been disposed through Public Auction conducted by the Provincial Government to satisfy Real Property Tax Delinquencies. b) Real Properties with pending cases in court for Real Property Tax Delinquencies. SECTION 5. Period of Availment . The period for availment of the tax amnesty herein provided shall be from January 2020 to June 2020. For this purpose, massive information and education campaign should be conducted by the City through the City Treasurer's Office, City Assessor's Office and the City Information Office in order to maximize availment of the benefits under this Ordinance. SECTION 6. Separability Clause . If any provision of this Ordinance is declared deemed invalid or unconstitutional, the remaining provision not affected thereby shall continue full force and effect. SECTION 7. Repealing Clause . All other ordinance, rules and executive orders inconsistent with the provisions of this Ordinance are hereby repealed or modified accordingly. SECTION 8.
