November 23, 1995 BIR RULING [UN-415-95] 3rd Indorsement Respectfully returned to the Assistant Commissioner (Collection Service) the within papers (xerox copies only) relative to the request of the Municipal Mayor of Calinog, Iloilo, for the release of the corresponding share of the municipality from the increase in the collection of value-added tax during the year 1994. cdtech Pursuant to the 2nd paragraph of Section 282 of the Tax Code, as amended by R.A. No. 7643, reading: "SEC. 282. Disposition of national internal revenue xxx xxx xxx "In addition to the internal revenue allotment as provided for in the preceding paragraph, fifty percent (50%) of the national taxes collected under Sections 100, 102, 112, 113 and 114 of this Code in excess of the increase in collections for the immediately preceding year shall be distributed as follows: (a) Twenty percent (20%) shall accrue to the city or municipality where such taxes are collected and shall be allocated in accordance with Section 150 of the Republic Act No. 7160 otherwise known as the Local Government Code of 1991; and (b) Eighty percent (80%) shall accrue to the National Government. xxx xxx xxx he is requested to verify the actual amount of VAT collected by the Revenue Collection Agent of Calinog, Iloilo during the years 1993 and 1994 and determine the share of said municipality in accordance with the aforequoted provisions. Thereafter, a certification of the amount of the municipality's share shall be issued and submitted to the Bureau of Treasury and the Department of Budget and Management which will effect the release of the share of the Municipality of Calinog from the increase in the collection of VAT. cdll ALICIA P.
