July 31, 1995 BIR RULING [UN-284-95] MEMORANDUM TO: The Chief, Internal Security Division Referred to you herewith is the handwritten letter dated May 24, 1995 of Mr. Vicente O. Gomez, 078 Lagundi, Morong, Rizal, denouncing the Assessment Division of Revenue Region No. 7, Quezon City, for alleged delay in transmitting to the Legal Division the docket bearing on the internal revenue tax case of P. Victorio Enterprises. The complainant alleged that P. Victorio Enterprises has a deficiency tax assessment in the amount of P5,365,016.77 the collection of which will prescribe in October 1995; that out of the said amount only P130,000.00 has so far been collected but the Revenue District Officer of Taytay-Cainta District never bothered to exert any effort to collect the amount of P800,000.00 garnished from taxpayer's account with the Department of Public Works and Highways; that the docket of the case was transmitted to the Assessment Division on February 7, 1995 but it took the latter four (4) months to forward the same to the Legal Division for prosecution. You are, therefore, directed to conduct an immediate investigation to ascertain the veracity of the foregoing allegation and to pinpoint the officials and/or employees responsible for the delay in taking action on the aforesaid internal revenue tax case of P.
