August 9, 1994 BIR RULING [UN-237-94] The Revenue District Officer Revenue District Office No. 88 Tacloban City S i r : This refers to the letter dated April 6, 1994 of Mr. Rogelio Ancheta-Labarette, President and Chairman of the Board of the Association of Tricycle Operators (ATO), Inc. Tacloban City, which was referred to this Office by the Secretary of Finance for comment relative to the protest of said association against the assessment made by the Office of the City Treasurer and City Accountant of Tacloban City increasing and fixing the yearly income of all MCH Operators at P40,000.00 per unit. In order that we can act on the request of the taxpayer "to ORDER the Bureau of Internal Revenue District Officer Nieto Racho and BIR City Hall Agent Erwin Oledan to refrain and desist from collecting deficiency assessment arising from the illegal assessment on income of MCH Operators . . ." you are hereby directed to forward to this Office within five (5) days from receipt hereof the paper(s), if you have any, regarding the said case, together with your comments hereon. cdtech Very truly yours, LIWAYWAY VINZONS-CHATO Commissioner of Internal Revenue
